PAYMENT METHOD Please note that while Niramit Auctions accepts payments via PayPal, there appears to be a 21 day hold on PayPal transactions and as this is a massive inconvenience to thee seller, we would appreciate if the buyer transfers the payment to us via other methods, if supported in your country, Wise seems to work best. Additionally, a fee may be charged for bidders paying a buyer's premium below 15%. The total fee that may be charged for PayPal transactions will be no more than 4% on top of the buyer's premium. For example, if the buyer is paying a buyer's premium of 9% and chooses to pay via PayPal, the total fee the buyer will pay may be up to 13%. (9% + 4%), whereas If the buyer is paying a buyer's premium of 12% and chooses to pay via PayPal, the total fee the buyer will pay may be up to 15%. (9% + 3%). GENERAL Niramit Auction Co., Ltd., referred to as (Niramit Auctions) acts only as consignee in the sale of assorted property, under contracts previously agreed on with the necessary items with whosoever owns the items. The data contained in the auction catalog or any other statement made about the author of the work, origin, age, date, state, authenticity, or price thereof, are the sole and exclusive responsibility of its owners. The auction will be held in national currency and with the minimum number of bidders previously determined by Niramit Auctions. NIRAMIT AUCTIONS is not responsible for the shipping and transportation of lots purchased at auctions or through direct sale. The BUYER accepts and acknowledges that NIRAMIT AUCTIONS is not responsible for the shipping and / or transportation of the lots acquired at auction and as a consequence, the BUYER releases NIRAMIT AUCTIONS from any type of liability for damages, loss or misplacement that the lots may suffer during their transportation. The BUYER, if required, must contract on his or her own the courier company that suits him or her best for the delivery of the purchased lot(s). The descriptions of item/lots appearing in the auction and in advertising prior to the auction are believed to be correct. Nevertheless, neither those descriptions nor any oral statements made by Owner/Seller or Auctioneer and employees concerning any item/lot shall be construed as a warranty, either expressed or implied. ITEM/LOTS ARE ALL SOLD AS IS - WHERE IS – HOW IS and WITH ALL FAULTS, known, apparent, or otherwise. Bidder acknowledges that all item/lots were available for inspection prior to the auction and, by these terms, Auctioneer and Owner/Seller strongly encouraged Bidder to carefully inspect each item/lot in which Bidder had any interest to determine the item/lot’s nature, quality, condition, quantity and size. All Bidders rely solely on their personal inspection and not on information listed on the Site or otherwise provided by Auctioneer and employees or Owner/Seller. Bidder’s failure to inspect, or otherwise to be fully informed as to the nature, quality, condition, quantity and size of any item/lot will not constitute grounds for any claim, adjustment, refund, termination of the contract for sale, or refusal to close the sale, against Auctioneer or Owner/Seller. the Bidder will be suspended or permanently banned from the Site if you, the Bidder, provides false information when registering, such as a false name or fraudulent contact information. LOTS The items that will be auctioned will be organized in lots made up of one or more items, in the order and numeration dictated by Niramit Auctions. The lots will be described and, in some cases, photographs will be included in the catalog manufactured by Niramit Auctions. The lots will be displayed for inspection at the location designated by Niramit Auctions, at least with 3 calendar days’ time before the auction. The staff of Niramit Auctions will be at your disposal to show any lot in detail. Lots will be auctioned in the physical condition in which they are consigned at the time of the auction, and therefore no refunds or claims will be accepted for damages, imperfections or restorations, even if this is not included in the description within the auction catalog. The estimated prices that are printed underneath the catalog descriptions are the approximate prices the items are expected to obtain in auction, not including the auction house’s commission. Lots that are auctioned will be offered at a minimum sales price previously agreed between the lot owner and Niramit Auctions, and may only be modified by a previously written agreement between the two parties. For auction purposes, the person who has the power to bid in the course of the auction will be now be referred to as “bidder” or “prospective buyer”. ABSENTEE BIDDING Staff authorized by Niramit Auctions may make bids on behalf of bidders at no charge to the bidder, and in accordance with the following rules: The bidder may send his position to Niramit Auctions up to four hours before the auction is held by providing the registration form for Absentee Bids directly to our offices or by email to the following address: absenteebid@niramitauctions.com; the format is available in our offices as well as on our website. Absentee Bids are only considered received and valid once the Bidder receives a receipt from absenteebid@niramitauctions.com. Niramit Auctions will need to have received the bidder's positions, indicating a maximum amount as the limit for each bid. In the event that the maximum limit set by the absent bidder is matched by the last bid of the room, Niramit Auctions is authorized to raise the next bid on behalf of the absent bidder; otherwise, the bidder present in the room will have priority over the lot. This information is considered confidential. As a guarantee of payment, in the event of the bidder physically going to Niramit Auctions to register offers for absentee bids, the bidder must sign a check or present proof of a bank-issued credit card to Niramit Auctions. Lots will be awarded at the lowest price allowed by other bids or postures in the room or by absent bidders. In the event of there being two or more absent potential buyers bidding for the same lot and for the same amount, the lot shall be awarded to the bidder whose offer has been submitted first in date and time. Otherwise, all normal auction rules apply. Niramit Auctions is NOT responsible if any of the absentee offers are unsuccessful. Niramit Auctions DOES NOT accept unlimited offers. EXPORT The buyer should always check whether authorizations, permits, or export/import licenses are required. By participating in the auction, you agree that it is your sole responsibility to obtain any export or import license, authorization, or permit required, and that the refusal to seek any required permit, authorization, or license, or any delay in obtaining them will not justify the termination or return of any purchased item, or any delay in making the full payment of the acquired property. BUYERS RENOUNCE ASKING FOR REFUNDS in any of the cases mentioned above. Local laws may prohibit the import or export of certain items, and/or may limit the resale of any property. If you have questions in regards to whether the property might fit into any of these scenarios, please ask us before buying. AUCTIONS At the beginning of the auction, the auctioneer will indicate the lot to be auctioned, either by means of the number corresponding to the auction catalog or by reading the description, characteristics, and starting price. The auction of each lot will start when the auctioneer announces the starting price of the same. At this time, the bidders will be able to make their offers or bids effective, and/or accept the position offered by the auctioneer. The auctioneer will be able to open the bidding of any lot by placing a starting price in the name of a seller. For the auctioneer to award a lot, there may be no new bids that improve upon the last one offered. Consequently, the price mentioned by the auctioneer will be the hammer or sale price to be paid by the bidder. Transportation of the purchased item will be at the buyer's expense. Once a lot has been awarded, no claims or cancellations are accepted. DELIVERY OF THE AWARDED ITEM The purchaser will be able to collect the item that was awarded to him as of the same business day that Niramit Auctions confirms the full payment of the sale price, and must collect it in accordance with the following. For catalog auctions, the purchaser will have a maximum period of 5 business days from the date of the auction on which the item was purchased for them to pay in full and collect it from Niramit Auctions’ JJ Mall location. As of the sixth day after the auction, a grace period consisting of 10 business days will begin in which there will be no charge for the storage of the lots. As of the eleventh day, if the purchaser has not collected his or her items, he or she will be obliged to pay THB 500.00 plus VAT daily for storage. All transportation expenses will be borne by the Purchaser who will also be solely responsible for loss, damage or any impairment that the item suffers during its transportation.
