TERMS & CONDITIONS OF SALE

1. All items are sold as is, where is, with all faults. There are no warranties or representations of merchantability of any other kind, express or implied. All artists' names and dates recorded in this catalog are not to be taken as unqualified attributions to the artists named. No attributions to any artist or date are made or intended as to authorship or date of execution. Therefore, none of the property in this catalog is subject to any guarantee of authenticity and/or provenance and all of the property is sold as is. All items are available for your examination prior to bidding. Your bidding will signify that you have examined the items as fully as you desire, or that you have chosen not to examine them. Written and oral descriptions are our opinions and should in no way be construed as a guarantee of any kind as to age, condition, materials, provenance or any other feature of items being sold. We recommend prospective bidders to examine all items in which they have an interest. If you require absolute certainty in all areas of authenticity, and the results of your evaluation leave uncertainty in your mind, we recommend you not bid on the item in question. We do not give refunds. All sales are final. No statement written or oral made by the auctioneer or any employee of "Art-Torg" Auctions shall be deemed a warranty or assumption of liability by "Art-Torg" Auctions or by any seller represented by "Art-Torg" Auctions.

Art Torg (further referred to as “AT”)

AT is an agent arranging sale of paintings and other pieces of art (further referred to as the “Property”) through online auction portals. AT does not own nor sell the Property. The Property is sold by its respective owners (further referred to as the “Sellers”), where AT only assists the Sellers in finding a buyer for the Property.

All the information and descriptions of all kind concerning the Property such as artist’s name, creation date, authenticity, etc. are supplied by the Sellers. AT does not and cannot verify the information. AT gives no warranties nor representations concerning the Property. Under no circumstances may AT be held responsible for any inaccuracy or discrepancy in any information concerning the Property.

BIDDER’S DEPOSIT

AT may require a prospective bidder to pay a deposit as a condition of registration or participation in the auction. If the bidder does not win any lot, the deposit will be refunded in full to the original payment method. If the bidder is the successful bidder, the deposit will be credited toward the total purchase price and any related amounts payable by the Purchaser. If the successful bidder refuses or fails to complete the purchase or pay the outstanding amount within the required payment period, the deposit will not be refunded and shall be retained by AT, without prejudice to any other rights or remedies available to AT or the Seller under these Terms and Conditions or applicable law.

The successful bidder (further referred to as the “Purchaser”) undertakes to pay the final purchase price of the Property and all the related costs under the conditions set by the auction portal. All sales are final and irreversible. AT grants no refunds nor reimbursements. The Purchaser further undertakes to supply AT with the shipping address and all other information necessary for delivery of the Property.

The Purchaser agrees that packing and shipping of the Property is done at the Purchaser's risk. All packing expenses, materials, carrier fees, insurance charges and any other related expenses are borne by the Purchaser and will be charged to the Purchaser before dispatch of the Property. The Property will not be dispatched to the Purchaser before the purchase price and all the related expenses have been fully paid by the Purchaser.

If a Purchaser breaches its obligation set herein, by the auction portal or by an applicable law, including the obligation to pay the purchase price or any related expenses, AT may seek all applicable remedies including cancelling the sale and reoffering the Property for sale without further reserve.

By bidding on any of the Property listed by AT the bidder confirms to have read and understood these TERMS AND CONDITIONS and agrees to respect and be bound by these TERMS AND CONDITIONS.
