Terms & Conditions

Auction Terms & Conditions INFORMATION FOR BUYERS 1. INTRODUCTION Greetings, valued bidders! This section is designed to provide essential guidance to all Buyers, especially those who are new to our dynamic online bidding platform. Our Online Live Auctions are governed by a set of Terms and Conditions tailored for the digital auction experience, along with any pertinent notices showcased on specific lot listings within our online auction catalogue. To familiarize yourself with the governing rules, our comprehensive Terms and Conditions for Online Live Auctions are readily accessible on our website at www.cultural-tradition.uk. Prior to placing a bid in our Online Auctions, it is imperative that you confirm your acceptance of these terms. If there are any aspects of our Terms and Conditions for Online Auctions that seem unclear or require clarification, do not hesitate to reach out to us. We are here to assist you in navigating the intricacies. 2. TERMS OF SALE FOR ONLINE LIVE AUCTIONS Before participating in any of our online auctions, we strongly advise a thorough reading of our Terms of Sale for Online Live Auctions. Your successful bid will entail an obligation to adhere to these terms, ensuring a smooth and satisfactory transaction. These terms serve as a vital framework for conducting business within the context of our Online Live Auctions. Your commitment to understanding and abiding by our Terms of Sale for Online Live Auctions is fundamental to a successful and enjoyable bidding experience. We appreciate your diligence in reviewing these terms, and we remain at your disposal for any inquiries or clarifications. 3. DESCRIPTIONS OF LOTS Whilst we seek to describe Lots accurately, it may be impractical for us to carry out exhaustive due diligence on each Lot. Prospective Buyers are given ample opportunities to view and inspect before any sale and they (and any independent experts on their behalf) must satisfy themselves as to the accuracy of any description applied to a Lot. Prospective Buyers also bid on the understanding that, inevitably, representations or statements by us as to authorship, genuineness, origin, date, age, provenance, condition or Estimated selling price involve matters of opinion. We undertake that any such opinion shall be honestly and reasonably held and only accept liability for opinions given negligently or fraudulently. Subject to the foregoing neither we the Auctioneer or our employees or agents accept liability for the correctness of such opinions and no warranties, whether relating to description, condition or quality of Lots, express, implied or statutory, are given. Please note that photographs/images provided may not be fully representative of the condition of the Lot and should not be relied upon as indicative of the overall condition of the Lot. All dimensions and weights are approximate only. 4. ELECTRICAL GOODS Electronic or mechanical items or parts are sold for their artistic, historic or cultural interest and may not operate or may not comply with current statutory requirements. You should not, and must not, assume that electrical items designed to operate on mains electricity will be suitable for connection to the mains electricity supply and you should obtain a report from a qualified electrician on their status before doing so. Such items which are unsuitable for connection are sold as items of interest for display purposes only. These are sold as 'antiques' only and if bought for use must be checked over for compliance with safety regulations by a qualified electrician first. 5. EXPORT OF GOODS Buyers intending to export goods should ascertain (a) whether an export licence is required and (b) whether there is any specific prohibition on importing goods of that character because, e.g. they may contain prohibited materials such as ivory. Ask us if you need help. 6. BUYER?S PREMIUM Please note a buyer?s premium is applied to all lots bought at auction. The buyer shall pay the hammer price together with a premium. 7. BIDDING Bidders may be required to register before the sale commences and lots will be invoiced to the name and address on the registration form. Some form of identification will be required if you are unknown to us. Please enquire in advance about our arrangements for telephone bidding. 8. REGISTERING TO BID If this is Your first time bidding at Cultural Tradition or You are a returning Bidder who has not bought anything from us within the last two years You must register at least 48 hours before an auction to give us enough time to process and approve Your registration. We may, at our discretion, decline to permit You to register as a Bidder. You will be asked for the following: - Individuals: Photo identification (driving licence, national identity card or passport) and, if not shown on the ID document, proof of Your current address (for example, a current utility bill or bank statement) - Corporate clients: Your Certificate of Incorporation or equivalent document(s) showing Your name and registered address together with documentary proof of directors and beneficial owners, and; Trusts, partnerships, offshore companies and other business structures please contact us directly in advance to discuss requirements. We may also ask You to provide a financial reference and/or a deposit to allow You to bid. For help, please contact our Finance Department: support@cultural-tradition.uk. If in our opinion You do not satisfy our Bidder identification and registration procedures including, but not limited to, completing any anti-money laundering and/or anti-terrorism financing checks we may require to our satisfaction, we may refuse to register You to bid, and if You make a successful bid, we may cancel the deal. 9. COLLECTION AND STORAGE Please note what the Conditions of Sale state about collection and storage. It is important that goods are paid for and collected promptly. Any delay may involve the buyer in paying storage charges. 10. WE ARE, PRIMARILY, AGENTS FOR THE SELLER We are dependent on information provided by the seller and whilst we may inspect lots and act reasonably in taking a general view about them we are normally unable to carry out a detailed or any examination of lots in order to ascertain their condition in the way in which it would be wise for a buyer to do. Intending buyers have ample opportunity for inspection of goods and, therefore, accept responsibility for inspecting and investigating lots in which they may be interested. Please note carefully the exclusion of liability for the condition of lots contained in the Conditions of Sale. Neither the seller nor we, as the auctioneers, accept any responsibility for their condition. In particular, mechanical objects of any age are not guaranteed to be in working order. Lots are sold to the Buyer on an "as is" basis, with all faults and imperfections. All questions of authenticity must be resolved prior to bidding. All catalogue lots are available for inspection by appointment via email: support@cultural-tradition.uk. 11. GENERAL Special terms may be used in catalogue descriptions of particular classes of items in which case the descriptions must be interpreted in accordance with any glossary appearing in the catalogue. English law applies to the interpretation of these Conditions. 12. PAINTINGS, DRAWINGS, LITHOGRAPHS, ENGRAVINGS AND PRINTS In accordance with long standing practice in Fine Art Sale Rooms certain terms used in descriptions in the Catalogue have the meanings ascribed to them in the glossary below.
