Términos y condiciones de venta Normas para la compra en subasta Comprar Cómo comprar en Templum Fine Art Auctions A lo largo del año Templum realiza distintas subastas tanto presenciales se edita un catálogo ilustrado, de venta en nuestra Sala diez días antes de cada subasta y de consulta en internet en: www.templumauctions.com Además puede realizar una suscripción anual a todos o a aparte de nuestros catálogos. Los lotes son expuestos en Templum Art Auctions, en horario de lunes a viernes de 9:30:00 a 20:00 h durante una semana antes de la fecha de subasta en el caso de las Subastas Mensuales, y 15 días antes de la fecha de la subasta en el caso de las Subastas Extraordinarias. Para poder pujar tiene cuatro opciones: -Puja por escrito -Puja por Internet -Puja telefónica (sólo en las Subastas Extraordinarias) -Puja directa en Sala El precio de remate se incrementará en un 23,50 % (IVA incluido) en concepto de derechos de subasta en todas las subastas (Mensuales, Extraordinarias y de Internet). Modos de pago: 1. - Transferencia Bancarias 2.- En nuestras oficinas en Templum Art Auctions: Para recogidas y pagos en sala: de lunes a Viernes de 9:30 a 17:30 h. 1. Los datos del catálogo se obtienen tras una cuidada investigación y asesoramiento. No obstante, las descripciones incluidas en él constituyen exclusivamente opiniones de expertos de Templum Fine Art Auctions o expresamente designados por la misma y, como tales, deben considerarse por los compradores, debiendo los interesados formarse las suyas propias. A tal efecto los objetos que se subastan, están expuestos al público varios días antes de la celebración de la Subasta. Cualquier manifestación impresa en el catálogo y referida a la autoría, atribución, naturaleza, origen, fecha de, procedencia y condición de los lotes, se rige por los términos y expresiones interpretativas generalmente aceptadas. Las catalogaciones, certificaciones u opiniones citadas en el catálogo se ofrecen y son tenidas por Templum Fine Art Auctions como una valiosa y útil información complementaria sobre los lotes catalogados, pero, de ningún modo, serán vinculantes o determinarán las responsabilidades de Templum Fine Art Auctions por las mismas. Por ello, el interesado en la compra de cualquiera de los lotes catalogados, podrá efectuar por su cuenta y previamente a su adquisición, las averiguaciones y comprobaciones que considere oportunas. Cada lote se vende como “cuerpo cierto”. Por el hecho de intervenir en la subasta, el interesado, DECLARA que conoce y muestra su conformidad con la situación física, jurídica y de autoría de los objetos/lotes adquiridos, y que la puja y eventual adquisición la lleva a cabo conforme a sus propios criterios y/o el de sus asesores, especialmente en lo que a la autoría de la obra se refiere, liberando a Templum Fine Art Auctions de cualquier responsabilidad por las opiniones manifestadas en relación con los objetos/lotes. 2. Los pesos de los lotes expresados en el Catálogo deben entenderse con carácter aproximado. En dichos pesos pueden estar incluidos metales no preciosos, guarniciones u otros elementos, que componen las joyas. Cuando el catálogo recoge la marca de un reloj, se transcribe exclusivamente la que consta en su esfera. En las monedas consta su valor facial y peso, sin que se garantice su autenticidad o valor numismático en ningún caso. La indicación "oro" y "plata" en el Catálogo, se utiliza, únicamente, para el oro de primera ley y para la plata de primera ley. Conforme a los usos y costumbres internacionales, Templum Fine Art Auctions no será responsable por los desperfectos, roturas, restauraciones, marcha de los relojes, etc., aún cuando no se hubieran hecho figurar en Catálogo. 3. En Templum Fine Art Auctions, están expuestas listas y catálogos con la reseña completa de los números, descripciones y precios de salida de cada uno de los lotes. Templum Fine Art Auctions puede acceder, a solicitud de los propietarios y con anterioridad a la subasta a retirar algún lote incluido en el Catálogo. Esta circunstancia será anunciada antes del inicio de la subasta o en el curso de la misma. 4. Figurarán en el Catálogo, debajo de cada lote, los precios de salida para su conocimiento por los compradores. Este precio de salida constituirá el mínimo de venta de cada lote, salvo en los casos excepcionales en los que se pueda pactar una reserva con el vendedor. Los términos utilizados en el catálogo tienen el significado que se indica a continuación: o Nombre y/o apellidos de un artista: En opinión de Templum Fine Art Auctions se trata de un trabajo del artista. o tribuido a: En la opinión cualificada de Templum Fine Art Auctions se trata probablemente de un trabajo del artista, ya sea en todo o en parte. o Estudio de... Escuela de... Taller de...: En la opinión cualificada de Templum Fine Art Auctions se trata de un trabajo realizado en el estudio o escuela del artista. o Círculo de: En la opinión cualificada de Templum Fine Art Auctions se trata de un trabajo realizado en el período del artista y que por tanto muestra su influencia. o Seguidor de... Siguiendo modelos de: En la opinión cualificada de Templum Fine Art Auctions se trata de un trabajo realizado siguiendo el estilo del artista o Escuela, pero no necesariamente por un alumno suyo, ni en su época. o Copia de...: En la opinión cualificada de Templum Fine Art Auctions se trata de una copia (de cualquier fecha) de un trabajo del artista. o Firmado... / Fechado... / inscrito...: En la opinión cualificada de Templum Fine Art Auctions la firma, la fecha, la inscripción son del artista. o Lleva firma... / Lleva fecha... / Lleva marca... Lleva etiqueta... / Lleva sello: En la opinión cualificada de Templum Fine Art Auctions la firma/ fecha/ marca/ etiqueta/ sello parecen haber sido incluidas por personas distintas al artista. o Fundido a partir de un modelo de: En la opinión cualificada de Templum Fine Art Auctions, la obra está realizada a partir de un modelo del artista. 5. En sesión Presencial se entiende por "puja" cada uno de los incrementos, por las distintas ofertas, que experimenta el precio del lote que se está subastando. Las pujas se efectuarán partiendo del precio de salida, con arreglo a la siguiente escala: De 50 € hasta 100 € – 5€ De 100 € hasta 200 € -10 € De 200 € hasta 500 € – 25 € De 500 € hasta 1.000 € – 50 € De 1.000 € hasta 2.000 € – 100 € De 2.000 € hasta 5.000 € – 250 € De 5.000 € hasta 10.000 € – 500 € De 10.000 € hasta 20.000 € – 1.000 € De 20.000 € hasta 50.000 € – 2.500 € De 50.000 € hasta 100.000 € – 5.000 € De 100.000 € hasta 200.000 € – 10.000 € De 200.000 € hasta 500.000 € – 25.000 € De 500.000 € en adelante 50.000 € A criterio de la mesa Cuando el precio del lote que se está subastando alcance durante la licitación un tramo superior de la escala, las sucesivas pujas se ajustarán a los "incrementos por puja" que le correspondan. En cualquier caso, el director de la subasta podrá variar el incremento de las pujas en el transcurso de la misma. El director de la subasta tendrá la facultad de realizar toda puja que no sobrepase la precedente en la cuantía aplicable en cada caso. Asimismo, el director de la subasta podrá solicitar la confirmación de una puja realizada. En la sesión Internet la escala de pujas es la establecida por el portal dónde se realiza la subasta, que automáticamente va avisando al correo del usuario si su puja ha sido superada, dándole la oportunidad de realizar una mayor, y así, sucesivamente hasta la hora exacta de cierre de la subasta, hora que viene indicada en cada lote. En sesión Presencial, las personas que vayan a tomar parte en la subasta, deberán acreditar su personalidad en la entrada de la Sala, dónde se les facilitará un "número de comprador" (raqueta) que les identificará durante la celebración del acto. Este número deberá ser exhibido por el postor en el momento de efectuar la puja, y devuelto en Recepción, a la salida. En la sesión Internet, las personas que vayan a tomar parte en la subasta deberán registrarse como usuarios del portal dónde se realiza la subasta, cumplimentando los pasos que en todo momento les serán indicados. 7. En la sesión Presencial serán admitidas órdenes de compra -pliegos abiertos o pujas por escrito- hasta 24 horas antes del inicio de la sesión correspondiente al lote/s solicitados, por medio de impresos que Templum Fine Art Auctions tiene dispuestos para este fin, tanto en la propia Sala .En las páginas finales del presente Catálogo, se incluye "Modelo de Orden de Compra (Puja por Escrito)". A través del portal de Internet, en www.templumauctions.com, mediante el formulario de pujas que se despliega en cada lote, enviándolo 24 horas antes de la sesión correspondiente. En las subastas extraordinarias también pueden efectuarse pujas por teléfono, debiendo cubrir el precio de salida e ir acompañadas de la fotocopia del D.N.I. o Pasaporte, en este caso, previa comunicación a Templum Fine Art Auctions y aceptación por parte de ésta con anterioridad al inicio de la subasta, siendo la Sala quien representará al comprador. No se admitirán pujas telefónicas por importes inferiores a 1.000 Euros. Si para un mismo lote se presentaran dos o más pliegos abiertos, la Mesa defenderá al que contenga la oferta más alta. En el supuesto de que existan varias ofertas iguales para un mismo lote, se defenderá por la mesa la correspondiente al pliego recibido en la Sala con anterioridad. Para la sesión de pliegos, deberán presentarse las ofertas también 24 horas antes de la sesión correspondiente. Templum Fine Art Auctions no se responsabiliza de dar curso a las órdenes de compra (pliegos abiertos o pujas por escrito), o formularios de Internet, que hayan entrado fuera del límite de hora establecido para las mismas. En la sesión Internet, Templum Fine Art Auctions se reserva el derecho a repetir la subasta, en el caso de que se diera alguna incidencia técnica que afectara al buen funcionamiento de la misma. 8. En la sesión Presencial, los lotes se adjudicarán al mejor postor, presente en la Sala o representado por la Sala por intervenir telefónicamente, o que hubiese efectuado ofertas previas por el sistema de pliego abierto (puja por escrito) o mediante el formulario de pujas que se despliega en cada lote a través de www.templumauctions.com. De producirse en la sala una oferta que iguale el máximo de la oferta del pliego, tendrá preferencia la presentada con anterioridad, es decir, la del pliego. En la sesión Internet, los lotes se adjudicarán al que haya sido el mejor postor "ganador" en el momento de cierre del lote en cuestión. El "ganador" recibirá automáticamente, un mensaje en su correo electrónico anunciándole como adjudicatario del lote en cuestión. 9. Templum Fine Art Auctions, en cumplimiento del o previsto en la Ley 16/85 del Patrimonio Histórico Español, comunicará a la Comunidad Autónoma correspondiente y al Ministerio de Cultura, con la antelación preceptiva, el contenido de sus Catálogos. Asimismo, notificará las concretas enajenaciones que pudieran efectuarse de acuerdo con lo establecido en la legislación vigente. Sobre los bienes sometidos a la Ley 16/85, la Administración podrá ejercer su derecho de tanteo cuando la venta se realice en pública subasta, únicamente durante la Subasta y manifestando su ejercicio en el momento del remate. 10. Los derechos del autor o de sus herederos sobre los lotes catalogados se respetarán con arreglo a la Ley de Propiedad Intelectual. 11. Para retirar el lote adjudicado, tanto en la sesión Presencial como en las sesiones de Internet, Pliegos, lotes de Subasta Extraordinaria y Venta Directa, el comprador deberá pagar el precio de remate incrementando en un 21% (IVA incluido). La titularidad del lote adquirido no pasará al comprador hasta que éste haya hecho efectivo el pago completo de dicho importe, disponiendo de un plazo de diez días hábiles para efectuar el pago total. Templum Fine Art Auctions no será responsable de los daños ocasionados a los lotes de la Subasta, cualquiera que sea su causa. At the discretion of the bureau When the price of the lot being auctioned reaches a higher range of the scale during the bidding, the successive bids shall be adjusted to the corresponding "bid increments". In the extraordinary auctions, bids can also be made by telephone, covering the starting price and accompanied by a photocopy of the ID or Passport, in this case, prior communication to Templum Fine Art Auctions and acceptance by the latter before the start of the auction, being the Room who will represent the buyer. Telephone bids will not be accepted for amounts less than 1,000 Euros. If two or more open bids are submitted for the same lot, the Table shall defend the one with the highest bid.
