Conditions of Sale

All property offered and sold through Billionaires Art Collection (“Billionaires Art Collection,” “the Company,” “Auctioneer,” “we,” “us,” or “our”) is offered and sold subject to the following Conditions of Sale. By registering to bid, placing a bid, or participating in any auction, whether online, by phone, absentee bid, in person, or through any representative, the bidder and/or buyer acknowledges that they have read, understood, and agreed to be legally bound by these terms and conditions.

Billionaires Art Collection makes every reasonable effort to catalogue, photograph, and describe each property accurately. However, all descriptions, photographs, measurements, condition reports, estimates, provenance, authorship, attribution, age, period, culture, origin, material, weight, count, size, and any other information provided are statements of opinion only and are not guaranteed. The Company assumes no risk, liability, or responsibility for any errors, omissions, inaccuracies, or differences in description.

All Sales Are Final — Sold As Is, Where Is

ALL PROPERTY IS SOLD “AS IS,” “WHERE IS,” AND “WITH ALL FAULTS.” THERE ARE NO RETURNS, REFUNDS, EXCHANGES, CANCELLATIONS, OR CHARGEBACK EXCEPTIONS AFTER A BID HAS BEEN PLACED AND ACCEPTED.

Neither Billionaires Art Collection nor any consignor makes any warranties or representations of any kind, express or implied, with respect to any property offered for sale. This includes, but is not limited to, warranties of title, authenticity, authorship, attribution, provenance, condition, merchantability, fitness for a particular purpose, size, weight, material, age, period, origin, value, or future resale value.

Billionaires Art Collection acts solely as an auction broker and/or agent and, unless otherwise stated, does not own the property being offered. The buyer accepts full responsibility for inspecting, researching, and evaluating each lot before bidding.

1. Reserves

Some lots may be offered subject to a confidential reserve, which is the minimum price agreed upon between the consignor and Billionaires Art Collection. A lot will not be sold below its reserve. The reserve will generally be below the published estimate, but the Company is not required to disclose the amount of any reserve.

Billionaires Art Collection may execute reserves by bidding on behalf of the consignor up to the reserve amount. The auctioneer may reject any bid, bidding increment, or raise that is not considered appropriate or commensurate with the value of the lot.

2. Catalogue Descriptions and Condition

All catalogue descriptions, photographs, videos, measurements, and condition statements are provided as a courtesy only. They are not warranties, guarantees, or representations of fact.

No statement made in the catalogue, invoice, bill of sale, advertisement, condition report, email, message, phone conversation, or at the time of sale shall be considered a warranty, representation, or assumption of liability by Billionaires Art Collection or the consignor.

Bidders are strongly encouraged to request additional photos, condition reports, measurements, and details before bidding. Failure to inspect or request additional information does not relieve the buyer of their obligation to pay.

3. Bidding and Winning Bidder

The highest bidder acknowledged by the auctioneer shall be the purchaser. In the event of a disputed bid, the auctioneer shall have sole and final discretion to determine the successful bidder, reject any bid, withdraw the lot, reopen the bidding, or reoffer the lot for sale.

Billionaires Art Collection reserves the right to refuse any bid, cancel any bid, refuse registration, or deny bidding privileges to any person at its sole discretion.

Any bidder planning to spend in excess of $100,000 may be required to make arrangements with the accounting department at least five business days before the sale. A deposit, proof of funds, bank letter, or other verification may be required before bidding privileges are approved.

4. Payment Deadline, Storage, and Forfeiture

All invoices must be paid in full within 10 calendar days of the auction date unless prior written arrangements have been approved by Billionaires Art Collection.

All purchased property must also be picked up or shipping arrangements must be completed within 10 calendar days of the auction date. After 10 days, a storage fee of $25 per day, per invoice or per lot, may be assessed.

If payment, pickup, or shipping arrangements are not completed within 30 calendar days, Billionaires Art Collection reserves the right to consider the property abandoned. Abandoned property may be resold, donated, disposed of, or otherwise handled at the Company’s discretion, without refund, credit, or further notice to the buyer.

5. Payment Methods

Billionaires Art Collection may accept cash, check, wire transfer, certified funds, or other approved payment methods. The Company reserves the right to hold merchandise purchased by check until the payment has fully cleared.

The buyer is responsible for any bank fees, wire fees, returned payment fees, chargeback fees, processing fees, or dishonored payment charges. A handling fee of $25 to $50 may be assessed for any returned, declined, reversed, or dishonored payment.

Payment must be made by the registered bidder unless otherwise approved in writing.

6. Non-Payment and Breach by Buyer

If the buyer fails to pay the full purchase price, refuses to complete payment, initiates an improper chargeback, fails to arrange shipping or pickup, or otherwise breaches these Conditions of Sale, Billionaires Art Collection may exercise all rights and remedies available under law.

These remedies may include, but are not limited to:

Canceling the sale; retaining any deposit or partial payments as damages; charging storage, administrative, legal, collection, and resale fees; reporting the buyer as unpaid to the auction platform; restricting or permanently banning the buyer from future auctions; reselling the lot at public or private sale with or without reserve; and holding the original buyer liable for any deficiency, loss, commission, buyer’s premium, storage, shipping, legal fees, collection fees, and all costs associated with the resale.

7. Limitation of Liability

In no event shall the liability of Billionaires Art Collection to any buyer exceed the actual purchase price paid by that buyer for the specific item in dispute.

Billionaires Art Collection shall not be liable for any indirect, incidental, special, consequential, emotional, punitive, or financial damages, including loss of profit, loss of value, loss of use, restoration costs, shipping delays, or buyer’s remorse.

8. Shipping and Pickup

Shipping is the sole responsibility of the buyer. Billionaires Art Collection may, as a courtesy, provide a list of third-party shippers or assist with shipping coordination; however, the Company is not responsible for the acts, omissions, pricing, delays, damage, packing quality, insurance, or delivery performance of any third-party shipper.

The buyer is responsible for all packing, handling, shipping, insurance, customs, duties, taxes, import/export permits, and delivery costs.

Some items may be large, heavy, fragile, or require professional packing and freight services. It is the buyer’s responsibility to understand shipping costs and logistics before bidding. Failure to obtain a shipping quote before bidding does not cancel the sale or payment obligation.

Billionaires Art Collection is not responsible for damage, loss, delay, or claims once an item has been released to the buyer, buyer’s representative, or shipping carrier.

9. Export, Import, and Restricted Materials

Some property may be subject to laws governing export from the United States or import into another country. This may include, without limitation, items containing restricted materials, endangered species materials, ivory, tortoiseshell, exotic woods, cultural property, or other regulated materials.

Obtaining any required permits, licenses, approvals, customs clearance, or import/export documentation is the sole responsibility of the buyer. Denial, delay, seizure, or failure to obtain such permits shall not cancel the sale or delay the buyer’s payment obligation.

10. Sales Tax

All purchases are subject to applicable sales tax unless the buyer provides a valid resale certificate, exemption certificate, or other documentation acceptable to Billionaires Art Collection before payment is processed.

Buyers are responsible for ensuring that any exemption documentation is valid, current, and applicable to the purchase. If proper documentation is not received, sales tax will be charged as required by law.

11. Buyer’s Premium

A buyer’s premium will be added to the final hammer price of each lot and is payable by the buyer as part of the total purchase price. The buyer’s premium may vary depending on the auction platform, sale type, or specific auction terms.

By bidding, the buyer agrees to pay the hammer price, buyer’s premium, applicable taxes, shipping, packing, handling, storage, platform fees, payment fees, and any other applicable charges.

12. Acceptance of Terms

By placing a bid, the bidder confirms full acceptance of these Conditions of Sale and any additional terms announced or posted before, during, or after the auction.

A bid is a binding contract to purchase. Once a bid is placed and accepted, the bidder may not retract, cancel, or refuse payment due to buyer’s remorse, failure to inspect, misunderstanding of size, condition, shipping cost, description, or any other reason.

13. Copyright and Reproduction Rights

Billionaires Art Collection and its consignors make no warranty or representation, express or implied, that the buyer will acquire any copyright, trademark, licensing, reproduction, or intellectual property rights to any lot sold.

All photographs, images, videos, illustrations, descriptions, written material, and catalogue content produced by or for Billionaires Art Collection remain the property of Billionaires Art Collection and may not be copied, reproduced, published, distributed, or used for commercial purposes without prior written consent.

Billionaires Art Collection reserves the right to reproduce and use images of any lot for marketing, advertising, archival, promotional, or business purposes before or after the sale.

14. Governing Law, Venue, and Attorney’s Fees

These Conditions of Sale shall be governed by the laws of the State of California, without regard to conflict of law principles.

The buyer and bidder agree that any legal action, claim, dispute, or proceeding arising from or related to these Conditions of Sale, the auction, any purchase, payment, shipping, or transaction with Billionaires Art Collection shall be brought in the appropriate state or federal courts located in California.

The buyer and bidder consent to the jurisdiction and venue of such courts and waive any objection to such jurisdiction or venue.

In any legal action or proceeding brought to enforce these Conditions of Sale, the prevailing party shall be entitled to recover reasonable attorney’s fees, court costs, collection fees, and all related expenses.

15. Measurements, Weight, Size, and Color

All measurements, weights, sizes, and dimensions are approximate and may vary. Billionaires Art Collection is not liable for discrepancies in height, width, depth, weight, scale, color, tone, material, or appearance.

Photographs may show color, patina, texture, or condition differently due to lighting, screen settings, angle, editing, or environment. Buyers should request additional information before bidding if exact size, color, or condition is important.

16. Condition Reports

Condition reports may be provided upon request as a courtesy only. Any condition report reflects the opinion of Billionaires Art Collection at the time it is given and may not include all defects, repairs, restorations, wear, losses, damage, or imperfections.

The absence of a condition report does not imply that the item is free from damage, restoration, wear, or defects. The mention of one condition issue does not mean there are no other condition issues.

17. No Guarantee of Authenticity or Attribution

Unless expressly stated in writing by Billionaires Art Collection, no lot is guaranteed as to authenticity, authorship, signature, artist, foundry, age, origin, period, provenance, edition, material, or historical significance.

Terms such as “attributed to,” “after,” “style of,” “manner of,” “school of,” “circle of,” “inspired by,” or similar language are statements of opinion only and are not guarantees.

18. Final Agreement

These Conditions of Sale, together with any posted auction terms, invoice terms, platform terms, and written notices from Billionaires Art Collection, constitute the entire agreement between the buyer and Billionaires Art Collection.

If any part of these Conditions of Sale is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

By bidding, the bidder confirms that they understand and agree that all sales are final, all property is sold as is, and the buyer is fully responsible for payment, shipping, inspection, and compliance with these terms.
