Terms and Conditions of Sale – Abell Auction Company

By registering to participate in any Abell Auction Company online sale and/or by placing a bid, you (“Buyer” or “Bidder”) expressly agree to be bound by these Terms and Conditions, as they may be amended from time to time, including without limitation all limitations of liability contained herein. Abell reserves the right to amend, modify, supplement, or remove any portion of these Terms at any time, and such changes shall be effective upon posting.

Buyer’s continued use of the website or participation in any auction following the posting of changes constitutes acceptance of those changes. If any modification is unacceptable, Buyer must discontinue use of the services.

Shipping & Pickup

Abell Auction Company provides limited in-house shipping services on select items. Buyers must refer to the Shipping tab on each individual lot page to determine eligibility. For items not eligible for in-house shipping, Buyer is solely responsible for arranging and paying for all packing, shipping, and transportation. Abell may provide recommendations for preferred third-party shippers as a courtesy only.

Property may be picked up at Abell’s Los Angeles facility. All local pickups are subject to applicable California sales tax unless a valid state-issued resale certificate is presented at the time of release.

Payment Terms

First-time Buyers paying by credit card are subject to a ten-day hold prior to release of property. All jewelry, precious metals, motor vehicles, and all international purchases must be paid by wire transfer; no exceptions apply. Credit card payments made directly to Abell are subject to a 3 percent convenience fee. Title to property shall not pass until all funds have cleared Abell’s banking institution.

Condition of Property

All lots are sold “AS IS,” “WHERE IS,” WITH ALL FAULTS. Neither Abell nor the consignor makes any warranties or representations, express or implied, with respect to any lot. Condition statements, whether written or oral, are opinions only and are provided as a courtesy. The absence of a condition statement does not imply that a lot is in perfect condition.

Descriptions, dimensions, weights, provenance, and other statements regarding a lot are approximate and should not be relied upon as statements of fact. Buyer is solely responsible for examining and determining the condition, authenticity, and suitability of any lot prior to bidding.

Estimates are expressions of opinion only and represent the range within which Abell believes the hammer price may fall. They do not include Buyer’s Premium or applicable taxes and are not guarantees of value or selling price.

Bidding & Auction Conduct

The highest qualified bidder recognized by the auctioneer shall be the Buyer. All successful bids are subject to a Buyer’s Premium in addition to the hammer price, as published for each auction. Abell reserves the right to reject any bid, withdraw any lot, reoffer any lot in the event of dispute, and refuse participation to any bidder in its sole discretion.

In the event of a dispute, the auctioneer’s decision shall be final and binding. If a bid is placed on behalf of an entity, the individual placing the bid personally guarantees payment.

Abell is not responsible for bidding errors, missed bids, technical failures, or the failure to execute absentee, telephone, or internet bids. All sales are final.

Collection, Storage & Abandonment

Property must be removed within seven (7) days of the auction date. After seven days, storage fees of the greater of $25 per lot per day or 10 percent of the purchase price per item, plus a $75 handling fee, shall apply.

Property not removed within twenty-one (21) days shall be deemed abandoned, and Abell may resell or dispose of such property without liability. Buyer remains responsible for any deficiency, storage fees, legal fees, collection costs, and all related expenses.

Taxes

Buyers are responsible for all applicable sales taxes unless proper documentation is on file with Abell before the auction.

Default & Remedies

If Buyer fails to comply with these Terms and Conditions, Abell may cancel the sale, retain payments as liquidated damages, resell the property publicly or privately, and hold Buyer liable for any deficiency and all related costs, including attorneys’ fees and expenses.

Dispute Resolution

Any dispute arising under these Terms shall be resolved exclusively by binding arbitration administered by JAMS under California law in Los Angeles, California, and the prevailing party shall be entitled to recover reasonable attorneys’ fees and costs.
