Shipping Info

Winning bidders will need to pay their invoice in full prior to picking up their Auction item(s). In person pick up of auction items will take place at the Attleboro Arts Museum, November 10th through November 14th, 2020. The Attleboro Arts Museum does not offer in-house packing or shipping services. Please contact us for a list of recommended carriers or to let us know that you have selected your own packer/shipper. At that time, we will provide you with details regarding purchased lot(s) needed for shipping. The Attleboro Arts Museum is unable coordinate packing or shipping arrangements for Auction buyers. Buyers are responsible for contacting shippers directly. Shipping/ packing arrangements must be made within 5 business days after the end of Auction. The Attleboro Arts Museum must receive payment for your purchase(s) before it can release your property to a shipping firm. Any expense related to packing, shipping and insurance (including reimbursement for damage or loss) of purchased lots is the responsibility of the buyer. In order to provide you with a quote, the shipper will need to know general information about the type of item(s) you need to ship including size, weight, value and ship to address. Once a shipper is chosen, the buyer is required to inform the Museum of the shipper information via phone at 508-222-2644 X 13 or via e-mail at office@attleboroartsmuseum.org in order for the Museum to release the purchased lot(s) to the packer/shipper. Please note: Responsibility and all liability of items as well as safe delivery is assumed by carrier, shipper, buyer, agent or packing company upon acceptance of merchandise. Terms & Conditions

The following terms and conditions are the complete and only terms and conditions on which all property is offered for sale. Any posted notices or oral announcements by the Auctioneer during the auction can amend this catalog. The Attleboro Arts Museum reserves the right to withdraw any property at any time before the sale ends in its sole and exclusive discretion. We reserve the right to reject any bid. The bidder acknowledged by the Auctioneer or designated Museum staff member will be the buyer. In the event of any dispute between bidders, or in the event of doubt on our part as to the validity of any bid, the Auctioneer or Auction Clerk will have the final discretion either to determine the successful bidder or to re-offer the disputed article for resale. All sales are final on the fall of the Auctioneer’s gavel or as indicated by a Bidsquare notification or designated staff member. Title to an offered lot will pass to the bidder acknowledged by the Auctioneer, subject to fulfillment by such bidder of all the conditions set forth herein, and such bidder thereupon assumes full risk and responsibility for the item and will pay the full purchase price. Winning bidders will be invoiced for lot(s) won within 48 hours of close of auction. Winning bidders will have up to 5 business days from receipt of invoice to pay in full. If the invoice is not paid in full within 5 business days of receipt the Museum reserves the right to re-offer the lot(s) won for resale. Purchased items that are not claimed within 140 days of auction close will be deemed forfeit, become property of the Museum, and no refund shall be issued to the winner. We guarantee the authenticity of authorship on the terms and conditions set forth below. Authorship means the identity of the creator, the period, culture source of origin of the property, as set forth in each catalog entry. Quality and Condition: Clients should carefully inspect all works, when possible, as quality and defects may be a matter of personal judgment. Lots are sold AS IS, WHERE IS. These conditions of sale shall be construed in accordance with the laws of the state of Massachusetts. The buyer/bidder agrees and consents to submit to the personal jurisdiction in the state and federal courts located in the venues of Attleboro, Massachusetts, United States. Guarantee Coverage: If within 14 days of the date of the sale of any lot, the original purchaser of record tenders to the Attleboro Arts Museum a purchased lot in the same condition as when sold and it is established that the identification of the Authorship of such lot is not substantially correct based upon written or oral statements made by the catalog or auctioneers, the sale of the lot will be rescinded and the original purchase price refunded. Non-Assignability: It is specifically understood that the benefits of this Guarantee are not assignable and shall be applicable only to the original purchase of the lot and not to any subsequent owners. Sole Remedy: It is further specifically understood that the remedy set forth herein, the rescission of purchase and return of the purchase price is exclusive and in lieu of any other remedy which might otherwise be available as a matter of law.
