The Smithsonian Visionary Benefit Auction by Rago
Beginning on April 24 and running until May 20, Rago Auctions presents the Smithsonian Visionary Artists Benefit Auction, a timed online-only auction hosted through Bidsquare.com and featuring items created by past and present Smithsonian Visionary Artists, sold to benefit the Smithsonian Institution. The Visionary Award, established in 2014, is presented annually at the Smithsonian Craft Show to artists who are deemed by curators in the field to have risen to the pinnacle in the world of sculptural arts and design, who have works in major museums, and who have demonstrated distinction, creativity, artistry, and of course, vision in his or her respective medium. The 2019 recipient of the Visionary Award, Joyce J. Scott, joins the small but prestigious list of past recipients; Faith Ringgold, Dale Chihuly, Toots Zynsky, Wendell Castle and Albert Paley. We congratulate Ms. Scott on receiving the 2019 Visionary Award, which is richly deserved. It is an honor to be associated with her.” This 13 lot sale will include works by Joyce J. Scott, as well as past Visionary Award recipients; Toots Zynsky, Albert Paley and Faith Ringgold. SMITHSONIAN WOMEN’S COMMITTEE 2019 VISIONARY BENEFIT AUCTION AUCTION RULES AND CONDITIONS OF SALE The art in the Smithsonian Women’s Committee Visionary Benefit Auction (“VBA”), made by former Visionary Award winners (each an “Artist”), is offered and sold by the Smithsonian Women’s Committee (the “SWC”) on the following Auction Rules and Conditions of Sale. Anyone registering to bid or placing a bid (a “Bidder”) accepts the Auction Rules and Conditions of Sale. These Auction Rules and Conditions of Sale constitute the entire agreement between the SWC and Bidder. A portion of the proceeds from the VBA go to grants for the Smithsonian Institution’s nineteen museums and nine research facilities. The Smithsonian Women’s Committee has collaborated with Rago Auctions (the “Auction House”) to market, promote and conduct the VBA. The Auction House will conduct the VBA for the SWC on the third-party online bidding platform Bidsquare (www.bidsquare.com). Additional terms and conditions of the Auction House and Bidsquare may apply to Bidder. The VBA is a timed online auction. Timed bidding means Bidder may place online bids any time up to the specified cutoff. Bidder is bidding against other online Bidders and is not bidding against anyone in a live auction simultaneously. Bid numbers may be obtained on-line at the applicable auction bidding platform. Information including Bidder’s name, telephone number and e-mail address will be collected by the Auction House in accordance with its terms and conditions. No Representations or Warranties All auction property is identified on the websites www.bidsquare.com; www.Ragoart.com; and Smithsoniancraftshow.org, as well as in the May 2019 Rago Design Auction catalogue. Every effort has been made to describe the property correctly and accurately. However, the SWC makes no other representations or warranties of any kind of nature, express or implied, regarding the correctness of the description, physical condition, quality or importance of the property or its fitness for any purpose. The Artist and the Auction House retain the rights to photographs, catalogue text, illustrations and other intellectual property contained in the catalogue and on the websites related to the VBA. 2. Valuation All items in the VBA are new works unless indicated. Values have been provided by the Artists or gallery and are estimates based on current retail prices. These values shall not be deemed a representation or warranty regarding the actual value of the property. All property is sold “as is”. 3. Withdrawal and Cancellation The SWC and the Auction House reserve the right to withdraw a lot for any reason and with no liability for such withdrawal. The SWC reserves the right to cancel the VBA for any reason and with no liability for such cancellation. 4. Time and Duration of Auction The auction begins at 12:01 a.m., Eastern Daylight Savings Time (EDT), April 24, 2019. The auction ends on May 20, 2019 at 7:00 P.M. EDT. 5. Auction Results Preliminary VBA results will be available online immediately at https://www.bidsquare.com/auction-house/rago. Final results will be available as soon as the Auction House has audited and verified all sales, usually within one day of the VBA. 6. Notification, Billing and Payment Upon the close of each timed lot in the VBA, the high Bidder becomes the buyer and owner of the property and is responsible for the amount of the successful bid, a 3% service charge, applicable taxes, and any other charges provided for in the Auction Rules and Conditions of Sale. Such amount shall be payable in U.S. Dollars, immediately. The SWC will contact the successful Bidders. The Auction House will send invoices to successful Bidders by email within two business days following the close of the VBA. The Auction House will collect the applicable payment due pursuant to the terms of the invoice. All sales are final. No refunds will be given for any reason. 7. Collection of Property The works for sale in the VBA reside with the Artist or gallery until sold. After the sale and upon receipt and clearing of payment in full, the SWC will notify and connect the successful Bidder to the Artist. Shipping and insurance will be arranged directly between the successful Bidder and the Artist. Unless otherwise agreed to by the Artist, the successful Bidder shall be responsible for any shipping and insurance charges. 8. Successful Bidder Default If payment for any lot of property is not received in full within fifteen (15) days of contact or if the SWC is unable to contact the winner within ten days after the close of the VBA, the SWC reserves the right to cancel the sale and contact the next highest Bidder. The property will be offered to this Bidder at their high bid. If the second Bidder accepts, they will be declared the winner by the SWC, who will supply the Auction House with the new successful Bidder’s contact information so that an invoice may be created and issued. The SWC has the sole and final discretion to determine the winner in the case of successful Bidder’s default. 9. Important Tax Information The amount of Bidder’s payment to the Smithsonian Women’s Committee that is deductible for federal income tax purposes is limited to the excess of Bidder’s successful bid over the total amount of the value of the item purchased plus any service charges, taxes or fees paid as set forth in these Auction Rules and Conditions of Sale. The retail value of each item offered was provided by the donor of that item and is printed on the auction page. Bidder may wish to print this for Bidder’s tax records.
