Auction Description

STREB 2024 Action Maverick Art Auction by  STREB, Inc.

A Benefit Auction in connection with STREB’s annual Action Maverick Award Benefit. This auction offers works from an array of artists including Judy Chicago, Robert Gober, Roni Horn, Cindy Sherman, and Tom Otterness.

The sale of these artworks will help sustain STREB's entire organization. Funds raised will directly support: Elizabeth Streb’s groundbreaking work through the STREB Extreme Action Company’s virtuosic performances; educational and community engagement programs that inspire and empower the Action Heroes and leaders of tomorrow; and scholarship and ticket subsidy programs which ensure accessibility to all.

For forty years, STREB has traveled artistically as well as geographically from the heights of the experimental dance world to the cutting-edge of popular entertainment - performing around the world in theaters large and small, serving as artists-in-residence at top art museums, and taking work into streets and sports stadiums. The company welcomes approximately 10,000 people to the Streb Lab for Action Mechanics (SLAM) annually through open rehearsals, weekly classes, school field trips, partnerships with community organizations, subsidized rehearsal space for working artists, Teen and Tween Action clubs, and summer camps.

Shipping Policy: STREB 2024 Benefit Auction

The Charity will arrange the shipping of the purchased lots with the buyer directly unless otherwise agreed. The buyer is responsible for the cost of shipping and all associated fees. Bidsquare and the Charity are not responsible for any acts which result in damages by carriers or packers of purchased lots, whether or not recommended by the Seller or Bidsquare, and will not be liable for any losses which result. The Charity will provide a reasonable amount of assistance to buyers in arranging shipping and insurance, but the buyer is responsible for claims of loss or damage and for contacting the insurer or carriers directly.

Once good payment has been received, the Charity will release the item and coordinate as soon as is reasonably possible but not later than 30 days after payment has been received, with the buyer for the transportation of the object.

Purchased lots will be shipped from the Charity’s office in New York City. Buyers may contact the Charity if they wish to arrange to pick up the purchased lot(s) personally.

Terms & Conditions

CONDITIONS OF SALE: STREB 2024 Benefit Auction

The property offered in this sale will be offered and sold by STREB (“the Charity”). Any questions should be directed to the Charity. The following terms and conditions, in addition to the terms outlined in the Bidsquare Site User Agreement and Conditions of Sale document posted on the Bidsquare website, will govern the sale of all the property offered at the auction:

 1. (a) The Charity does not assume any risk, liability or responsibility for the authenticity of the authorship of any property offered at this auction (that is, the identity of the creator or the period, culture, course or origin, as the case may be, with which the creation of any property is identified). 

(b) All property is sold “as is” and the Charity does not make any representations or warranties of any kind or nature, expressed or implied, with respect to the property, and in no event shall it be responsible for the correctness of any catalogue, listing, or notices or descriptions of property, nor be deemed to have made any representations or warranty of physical condition, size, quality, importance, attribution, or authenticity of this property. No statement in any catalogue, website, notice or description made at the sale, in any bill of sale invoice or elsewhere, shall be deemed such a representation of warranty or any assumption of liability. 

(c) The Charity does not make any representation or warranty, expressed or implied, as to whether the purchaser acquires any reproduction rights in the property. 

2. Bidding and Buying. 

(a) Users who bid on an item are required to complete the transaction. A bid is a legally binding agreement to complete a sale. 

(b) All lots on the site have a minimum bid or reserve requirement. The Charity is not obligated to sell an item unless the sale closes and the minimum bid or reserve bid has been met. 

(c) All lots are subject to extended bidding. In this process, bids received in the final 5 minutes of a sale will reset the bid timing back to 5 minutes. This time extension allows all users who wish to bid, time to bid. 

(d) Bidsquare and the Charity reserve the right to remove any lot from the site, modify descriptions, or make any changes to any auction at any time. Bidsquare and the Charity may for any reason and at any time refuse to process a bid, restrict bidding, or block a bidder from the site. All users of this site agree to hold Bidsquare and the Charity completely blameless for any of the above. 

(e) If any dispute arises after the sale, the Charity’s sale records shall be conclusive in all respects.

3. Payment Policy. Payment will be made immediately and will constitute the total purchase price of the high bid. Payment must be made in a manner acceptable to the Charity. Lots will not be shipped until good payment has been made. If payments are not received within 14 days in spite of communications and attempts to receive payments by the Charity, the Charity may choose to cancel the sale and reoffer the lot. Any payments made by a purchaser that are incomplete during this period are forfeited by the purchaser, as well as any title to the lot in question, unless a mutually acceptable agreement between the Charity and the purchaser is in effect.
(a) A buyer’s premium will not be applied to the lots sold in the STREB benefit sale.

(b) Pursuant to Section 1116(A) of the New York Sales Tax Law, no New York State or local sales tax is required on the purchase of lots offered for sale by the Charity, as long as such purchases are delivered within the state of New York.

(c) All items must be picked up or arranged to be shipped within 14 days of the sale closing. If items have not been paid for and picked up or shipped within the 14 day limit, the Purchaser will forfeit ownership of the lot(s) and the Charity may charge a late payment fee, storage fee, or choose to pursue legal action. The Buyer will be held liable for damages incurred, including the original purchase price, costs to reoffer the item, full commissions, legal fees, storage fees, and other related expenses.
