Conditions of Sale

1. Condition of Artwork

All artwork is sold "AS IS." All sales are final.

The Jackson Hole Chamber of Commerce ("JHCC") and participating artists make no warranties or representations, express or implied, regarding the artwork's condition, dimensions, description, authorship, authenticity, or fitness for a particular purpose.

QuickDraw artwork is created immediately prior to the auction and may still be wet at the time of sale. Variations resulting from the creative process are inherent to the artwork and are not considered defects.

Prior to bidding, in-person attendees have the opportunity to view the artwork during the QuickDraw event. Online bidders are provided with photographs of each artwork and a live video broadcast of the auction. All bidders are encouraged to review the available images, video, and artwork information carefully before placing a bid.

Questions regarding a specific artwork may be directed to JHCC prior to the close of bidding. JHCC will make reasonable efforts to obtain additional information from the representing gallery or artist prior to the close of bidding when feasible.

2. Inspection

By placing a bid, bidders acknowledge they have had the opportunity to inspect artwork or request additional information prior to the auction and accept the artwork in its present condition.

3. Withdrawal of Artwork

JHCC reserves the right to withdraw any lot from the auction prior to the close of bidding without liability.

4. Hybrid Bidding

The Jackson Hole QuickDraw Auction is conducted as a live auction with simultaneous in-person and online bidding.

Bids submitted in person and online compete equally. In the event that two or more bids are received simultaneously, including one submitted in person and one submitted online, the Auctioneer has sole and final discretion in determining which bid is recognized first.

The Auctioneer's decision shall be final.

JHCC reserves the right to reject any bid, reopen bidding on any lot, or resolve any bidding dispute in the manner it deems appropriate.

5. Online Bidding

Online bidding is offered as a convenience to remote participants.

JHCC is not responsible for interruptions in internet service, communication delays, software malfunctions, platform outages, or other technical issues beyond its control that may affect a bidder's ability to participate.

In the event of a technical disruption, JHCC reserves the right to pause, extend, or otherwise modify bidding procedures as necessary to ensure a fair auction.

By registering to bid online, bidders also agree to comply with the terms and conditions of the online auction platform.

6. Successful Bid

Unless otherwise announced, all bids are per lot.

The highest bid recognized by the Auctioneer at the close of bidding shall be deemed the successful purchase.

In the event of any dispute regarding bidding, the Auctioneer's decision shall be final, and JHCC's auction records shall govern.

7. Possession of Artwork

Title to, and risk of loss for, the artwork transfers to the successful bidder immediately upon the Auctioneer's acceptance of the final bid.

Live Auction Purchasers

Purchasers attending the auction in person are expected to complete payment and take possession of their artwork at the conclusion of the event.

Because many QuickDraw paintings remain wet, purchasers are encouraged to coordinate pickup and shipping directly with the gallery representing the artist. The galleries may retrieve the artwork from the event and arrange professional packing and shipment on the purchaser's behalf.

JHCC staff and volunteers may, as a courtesy, assist in facilitating communication between purchasers and representing galleries, but assume no responsibility for the care, transportation, packing, shipment, or storage of purchased artwork.

If a purchaser elects to personally transport the artwork to the representing gallery, all handling and transportation are at the purchaser's sole risk.

Online Purchasers

Artwork will be released following payment in full and completion of pickup or shipping arrangements.

The Jackson Hole Chamber of Commerce does not provide storage facilities for purchased artwork and assumes no responsibility for handling, transporting, storing, packing, or shipping artwork following the auction.

Any artwork remaining after the event without prior arrangements with the representing gallery may, at JHCC's discretion, be transferred to the representing gallery or otherwise handled at the purchaser's sole expense and risk.

8. Default

Failure to make payment within the required timeframe constitutes default.

JHCC reserves the right to cancel the sale, retain any payments made, resell the artwork, and pursue all remedies available under applicable law.

The defaulting purchaser shall remain responsible for any deficiency resulting from a resale, together with all associated costs and expenses.

9. Sales Tax

Applicable sales tax will be collected where required by law.

Purchasers claiming tax exemption must provide appropriate documentation prior to invoicing.

10. Copyright

Copyright and all reproduction rights remain the property of the artist unless otherwise agreed in writing.

JHCC reserves the right to photograph and reproduce images of artwork for promotional, educational, archival, and future event marketing purposes.

11. Governing Law

These Terms and Conditions shall be governed by the laws of the State of Wyoming.

Any legal action arising from these Terms and Conditions shall be brought in the appropriate state or federal courts located in Teton County, Wyoming.

12. Acceptance of Terms

By registering for or participating in the Jackson Hole QuickDraw Auction, whether bidding in person or online, each bidder acknowledges that they have read, understood, and agree to these Terms & Conditions.
