Similarly, your participation in online auctions will be regulated by the Conditions of Sale associated with the relevant auction, while Treasure Trove Auction's consignments and purchases are subject to terms available at www.treasuretroveauctions.com.
We reserve the right to modify these Terms of Use periodically and at our discretion, without prior notice, by publishing such changes on the Treasure Trove Auction Website. It is your responsibility to regularly review the Terms of Use. 2.1 Treasure Trove Auctions welcomes international customers. However, it is your responsibility to ensure that the products you order comply with the import regulations and laws of your country. We are not liable for any customs duties, taxes, or fees incurred during the importation process.
2.2 Please note that international shipping times may vary, and factors such as customs clearance, local postal services, and other unforeseen circumstances can affect delivery times. We strive to provide accurate estimates, but we cannot guarantee specific delivery dates for international orders. If your shipment is delayed or held up by customs, we will do our best to assist you in resolving any issues. However, any additional charges, fees, or fines imposed by customs authorities are solely the responsibility of the customer.
2.3 It is essential to provide accurate and complete shipping information, including a valid phone number and email address, to facilitate smooth customs clearance and delivery. Failure to do so may result in delays or the return of the shipment, with no guarantee of reattempt.

3.4 Buyer Due Diligence & Final Responsibility: Before placing a bid or purchase, buyers should independently verify all product details, including but not limited to authenticity, age, condition, provenance, and functionality. Treasure Trove Auctions bears no liability for buyer dissatisfaction due to misinterpretation, incorrect assumptions, or failure to perform due diligence.

Once a transaction is completed, no disputes or claims regarding product information will be entertained.
3.6 No Copyright or Reproduction Rights: Treasure Trove Auctions makes no warranty or representation, express or implied, that the purchaser will acquire any copyright or reproduction rights to any lot sold. Treasure Trove Auctions expressly reserves the right to reproduce any image of the lots sold in the catalogue or online.

4. Pricing and Payment
4.1 A Buyer's Premium of 23-28% will be applied to all purchases made for Treasure Trove products, as outlined on the platform you participate in. Additionally, a varying credit card processing fee will be charged for payments made through external 3rd party platforms, such as LiveAuctioneers, unless alternative payment arrangements are made directly with Treasure Trove Auctions within three (3) days of the invoice date.
4.2 All prices on our website are in U.S. dollars. We reserve the right to change prices at any time without prior notice. Payment can be made using the accepted payment methods listed on the website. International customers are responsible for any currency conversion fees, as well as additional fees imposed by their financial institution.
4.3 Autopay: If you have not contacted Treasure Trove Auctions to arrange payment within three (3) days of the time that invoice is sent, we will charge the credit card you used to register for the auction for the amount of your invoice.
4.4 Payment for High-Value Items: Due to the high amount of fraud with purchases of gold, watches, fine jewelry, and other high-value items, we reserve the right to hold packages until funds have cleared our bank and been confirmed valid if paying by credit card directly to Treasure Trove Auctions. Payments made via wire transfer will be shipped immediately after verification. We apologize for any inconvenience, but this measure is necessary to protect our company from fraudulent transactions.

5. Shipping and Delivery
5.1 We strive to provide a seamless and efficient shipping experience for our customers. Our team works diligently to process and dispatch orders promptly, ensuring that your products reach you in a timely manner. However, it's important to note that shipping times may vary, particularly for international orders. Factors such as, but not limited to, customs processes, transportation issues, handling time, white glove preparation, and unforeseen circumstances that are beyond our control may contribute to delays. While we make every effort to minimize any potential setbacks, we cannot be held responsible for circumstances outside of our influence.
5.2 Shipping Lead Times: Standard shipping lead times are usually 2-3 weeks from payment confirmation. During unusually busy periods, shipping may take longer. If you require specific delivery timing, please contact our support team prior to bidding for current estimated lead times. We can accommodate often, inquire!
5.3 All items are shipped on an "as-is, where-is" basis, and risk of loss or damage transfers to the buyer upon release of the item to the shipping carrier. Treasure Trove Auctions assumes no liability for lost, stolen, delayed, or damaged shipments once the item has been transferred to the carrier. The buyer is responsible for selecting appropriate shipping methods and purchasing insurance if desired. Treasure Trove Auctions will not be held responsible for any carrier-related delays, mishandling, or failures in delivery.
5.4 Treasure Trove Auctions may, at its discretion, offer a premium White Glove Shipping Service, which provides custom packaging and enhanced handling. This service is available for an additional charge and does not alter or extend the limitations of liability outlined in this section. The buyer acknowledges that participation in White Glove Shipping does not imply or guarantee any additional protections beyond those provided by the carrier or insurer.
5.5 International buyers acknowledge that they are solely responsible for all applicable customs duties, taxes, clearance fees, import restrictions, and any other charges imposed by their respective countries. These costs are not included in the purchase price or shipping fees and must be paid directly to the appropriate authorities. Treasure Trove Auctions makes no representations or warranties regarding the customs clearance process and will not be held responsible for items delayed, seized, or refused by customs. No refunds, cancellations, or chargebacks will be permitted due to customs-related issues.
5.6 Buyers who opt to use a third-party shipping provider assume full responsibility for their selection and for any issues that may arise, including loss, damage, or non-delivery. Treasure Trove Auctions shall bear no liability for the acts, omissions, or negligence of any third-party shipper, even if recommended by Treasure Trove Auctions. The buyer acknowledges that once an item has been released to a third-party shipper, Treasure Trove Auctions is fully discharged of any further obligations related to that item.
5.7 Treasure Trove Auctions will provide tracking information when available but makes no guarantees regarding tracking accuracy, carrier delivery estimates, or updates. The buyer acknowledges that delivery times are subject to carrier availability, transportation disruptions, weather conditions, and other factors beyond the control of Treasure Trove Auctions. No refunds, returns, or adjustments will be granted for shipping delays.
5.8 Collection Timeframes: Purchased items must be collected within seven (7) business days following the sale. Items not collected within this period will incur storage charges of $5 per lot per day. Items uncollected after thirty (30) days will incur an additional administrative fee of $75. Property which is paid for but left on our premises for any reason in excess of sixty (60) calendar days is subject to resale with the balance of any funds recovered in excess of storage charges and fees being remitted to the buyer.

6. Returns and Exchanges
WE DO NOT ACCEPT RETURNS OR EXCHANGES. ALL SALES ARE FINAL.
6.1 Binding Agreement: By participating in the auction, placing a bid, and completing a purchase, the buyer explicitly acknowledges and agrees that all sales are final and non-refundable, regardless of condition, description, or any other factor.
6.2 No Exceptions Policy: We do not accept returns, exchanges, or cancellations for any reason, including but not limited to: Buyer's remorse, change of mind, or incorrect bidding, discrepancies in item descriptions, photos, or perceived condition, damage during shipping (buyers are responsible for purchasing shipping insurance, if desired), any other claim, including defect, misrepresentation, or dissatisfaction.
6.3 Buyer Due Diligence: It is the buyer's sole responsibility to review all item descriptions, photographs, and condition reports prior to bidding. Buyers are encouraged to ask any questions before placing a bid, as all items are sold "AS IS" with no guarantees or warranties of any kind.
6.4 No Warranties: Treasure Trove Auctions makes no representations, warranties, or guarantees—express or implied—regarding the condition, authenticity, merchantability, fitness for a particular purpose, or value of any item sold.
6.5 Indemnification & Waiver of Claims: By participating in this auction, buyers waive all rights to dispute charges or initiate chargebacks, claims, or legal actions related to their purchase. Buyers agree to indemnify and hold harmless Treasure Trove Auctions, its owners, employees, affiliates, and representatives from any claims, liabilities, or losses arising from their participation in the auction.

7. Bidding Policies and Procedures
7.1 Bidding as Principal: When making a bid, a bidder is accepting personal liability to pay the purchase price, including the buyer's premium, all applicable taxes, shipping, and all other applicable charges, unless it has been explicitly agreed upon in writing with Treasure Trove beforehand. Auctions before the commencement of the sale that the bidder is acting as agent on behalf of an identified third party acceptable to Treasure Trove Auctions, and that Treasure Trove Auctions will only look to the principal for payment.
7.2 Absentee Bids: We will use reasonable efforts to carry out written bids given to us at least 24 hours prior to the sale for the convenience of clients who are not present at the auction in person, by an agent, or by telephone. Bids must be placed in U.S. dollars. If we receive written bids on a particular lot for identical amounts, and these are the highest bids on the lot at the auction, it will be sold to the person whose written bid was received and accepted first. Execution of written bids is a free service undertaken subject to other commitments at the time of the sale, and we do not accept liability for failing to execute a written bid or for errors and omissions in connection with the written bid.
7.3 Telephone Bids: On lots with a low estimate of $300 and above, and if a prospective buyer makes arrangements with us prior to the commencement of the sale, we will use reasonable efforts to contact them to enable them to participate in the bidding by telephone. We do not accept liability for failure to do so or for errors and omissions in connection with telephone bidding. These telephone bids may be recorded at the discretion of Treasure Trove Auctions.
7.4 Online Bids: We will use reasonable efforts to carry out online bids and do not accept liability for equipment failure, inability to access the Internet, or software malfunctions related to the execution of online bids. We will do our best to capture all bids from any platform but offer no guarantees of acceptance and recognition.
7.5 Reserves: Some lots in the sale are subject to a reserve, which is the confidential minimum price below which such lot will not be sold. Reserves are agreed upon with consignors or, in the absence thereof, at the absolute discretion of Treasure Trove Auctions. The auctioneer may open the bidding on any lot below the reserve by placing a bid on behalf of the seller. The auctioneer may continue to bid on behalf of the seller up to the amount of the reserve, either by placing consecutive bids or by placing bids in response to other bidders. With respect to lots that are offered without reserve, unless there are already competing bids, the auctioneer, in his or her discretion, will generally open the bidding at a percentage of the low estimate for the lot. In the absence of a bid at that level, the auctioneer may proceed backwards at his or her discretion until a bid is recognized, and then continue up from that amount.
7.6 Auctioneer's Discretion: The auctioneer has the right at his or her absolute and sole discretion to refuse any bid, to advance the bidding in such a manner as he or she may decide, to withdraw any lot, and in the case of error or dispute, and whether during or after the sale, to determine the successful bidder, to continue the bidding, to cancel the sale or to reoffer and resell the item in dispute. If any dispute arises after the sale, our sale record is conclusive.
7.7 Bidding Disclosure: This auction permits bids to be placed by the auctioneer, an employee of the auctioneer, or the seller or an agent on the seller's behalf.
7.8 Successful Bid: The highest bidder acknowledged by the auctioneer will be the purchaser. In the case of a tie bid, the winning bidder will be determined by the auctioneer at his or her sole discretion. In the event of a dispute between bidders, the auctioneer, or Treasure Trove Auctions, has final discretion to determine the successful bidder or to reoffer the lot in dispute. If any dispute arises after the sale, the Treasure Trove Auctions sale record shall be conclusive. Title passes upon the fall of the auctioneer's hammer to the highest acknowledged bidder, subject to the Conditions of Sale set forth herein, and the bidder assumes full risk and responsibility.

8. Non-Payment Consequences
8.1 If we do not receive payment in full, in good, cleared funds, within seven 3-7 business days following the sale, we are entitled in our absolute discretion to exercise one or more of the following measures, in addition to any additional actions available to us by law:
a) To impose a late charge of one and a half percent (1.5%) per thirty (30) days of the total purchase price b) To hold the defaulting buyer liable for the total amount (including hammer plus buyer premium, fees, and shipping) due and to begin legal proceedings for its recovery together with interest, legal fees, and costs to the fullest extent permitted under applicable law c) To cancel the sale d) To resell the property publicly or privately with such terms as we find appropriate, to resell the property at public auction without reserve, and with the purchaser liable for any deficiency, cost, including handling charges, the expenses of both sales, our commission on both sales at our regular rate, all other charges due hereunder and incidental damages e) To offset against any amount owed f) To not allow any bids at any upcoming auction by or on behalf of the buyer g) To take other action as we find necessary or appropriate
8.2 In addition, a defaulting purchaser will be deemed to have granted us a security interest in, and we may retain as collateral security for such purchaser's obligations to us, any property in our possession owned by such purchaser. At our option, payment will not be deemed to have been made in full until we have collected funds represented by checks, cash, ACH, or in the case of bank or cashier's checks, or any confirmed verifiable and cleared receival of funds, including our process to confirm their authenticity.

9. Governing Law and Jurisdiction
9.1 These Terms are governed by the laws of the state of Texas, United States. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in the state of Texas.

10. Indemnity
10.1 You commit to indemnify, protect, and absolve us, as well as our subsidiaries and affiliates, encompassing associated costs, liabilities, and legal fees, from any claim or demand initiated by a third party in connection with: (i) your utilization of or access to the Services; (ii) your infringement upon any third-party rights, including but not limited to copyrights, property, or privacy rights; (iii) the substance of your Submissions; or (iv) your violation of the Terms of Use. We retain the right, at your expense, to assume the exclusive defense and control of any matter requiring indemnification from you, and you pledge to collaborate in such defense. You further agree not to settle any matter for which you bear indemnity responsibilities without obtaining our prior written consent. We will make reasonable efforts to inform you of any such claim, action, or proceeding as soon as we become aware of it.

11. Intellectual Property
11.1 All content on our website, including but not limited to logos, images, text, and product designs, is the intellectual property of Treasure Trove Auctions and is protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, modify, adapt, or distribute our content without our express written consent.
11.2 Unauthorized use of our intellectual property may result in legal action and the enforcement of our rights. If you wish to use or license any of our content, please contact us to obtain the necessary permissions.
