1. These Conditions of Sale constitute the agreement between Victorins LLC, doing business as Victorins Auctions (“Victorins,” “Auctioneer,” “we,” or “us”) and the consignor (“Consignor”) with the buyer (“Buyer”) for the property listed in any Victorins auction catalog or presented for sale.
2. The Conditions of Sale, glossary, and all other content of the catalog or online listing are subject to amendment by Victorins Auctions by posted notice, announcement during the sale, or other written notice.
3. All property is offered by Victorins Auctions as agent for the Consignor unless expressly stated otherwise in the catalog.
4. By participating in any sale, whether in person, online, by absentee bid, or telephone, the Consignor, Bidder, and Buyer agree to be bound by these Conditions of Sale. These Terms and Conditions apply universally across all platforms and bidding methods, including but not limited to sales conducted through LiveAuctioneers, Bidsquare, Invaluable, BidSpirit, HiBid, or any other online or live auction platform, as well as live in-room bidding, phone bids, and absentee bids. All transactions, regardless of venue or format, are governed exclusively by these same Terms and Conditions of Sale.
5. Victorins Auctions reserves the right to amend or supplement these terms at any time, including announcements made during an auction, which shall be binding.
6. All bidders are deemed to have read, understood, and agreed to these Terms and Conditions before bidding.
Section II – Registration and Bidding
7. Bidders must register prior to bidding by completing a registration form in person or online, providing proof of identification, and supplying bank or other financial references if requested.
8. By registering, bidders agree to be liable for all bids placed under their account, including timely payment for any winning bids.
9. Bidders are responsible for independently verifying the age, size, condition, authenticity, description, and value of each lot before bidding.
10. All bids are per lot as numbered in the catalog unless otherwise announced by the Auctioneer.
11. Victorins Auctions reserves the right to reject any bid or bidder at its sole discretion.
12. The Auctioneer may split increments, reject insufficient advances, and has final discretion to determine the winning bidder or to re-offer a disputed lot.
13. In the case of absentee bids, Victorins Auctions will attempt to purchase the lot at the lowest price possible, subject to reserves and competing bids, but is not responsible for errors, failure to execute bids, or inability to contact bidders by phone or online.
14. Online and phone bidding are offered as a convenience, and Victorins Auctions is not responsible for any technical failures or errors in execution.
15. Victorins Auctions reserves the right to withdraw any lot at any time before or during the sale without liability.
Section III – Sale and Title Transfer
16. Placing a bid constitutes a legally binding offer to purchase the lot.
17. Upon the fall of the Auctioneer’s hammer, title to the lot passes to the highest bidder acknowledged by the Auctioneer, subject to compliance with these Conditions of Sale.
18. A buyer’s premium of twenty percent (20%) of the successful bid price will be added to all lots and is payable by the Buyer as part of the total purchase price.
19. Video or digital images may be used during the sale, but Victorins Auctions is not liable for errors in image quality or presentation.
20. Reserves may be executed by the Auctioneer or an authorized representative on behalf of the Consignor.
Section IV – Payment Terms
21. Payment is due immediately after the auction for the full purchase price, including the hammer price, buyer’s premium, applicable taxes, and any additional fees.
22. Accepted payment methods include U.S. dollars by cash, check, wire transfer, or credit card through the online auction platform.
23. A surcharge may be imposed on all credit card transactions, not greater than the cost of acceptance.
24. If you have a card on file with LiveAuctioneers, it will be automatically charged seventy-two (72) hours after you receive your invoice unless prior arrangements are made.
25. Invoices must be paid either entirely via LivePayments or entirely off-platform; mixed payment methods are not permitted.
26. For payments exceeding two thousand dollars ($2,000) or for new bidders without sufficient payment history, Victorins Auctions may require payment via wire transfer.
27. Out-of-state sales will not incur sales tax if paid directly to Victorins Auctions via wire transfer; however, sales tax will be applied if payment is processed through LiveAuctioneers in any manner.
28. Buyer agrees not to initiate or threaten any chargebacks for any reason. Even if a chargeback is successful, Buyer remains liable for the purchase price, costs of collection, and attorney’s fees.
29. A late fee of one and one-half percent (1.5%) per month will be charged on any overdue balance. Returned checks will incur additional fees.
30. In case of non-payment, Victorins Auctions may cancel the sale, resell the lot, retain deposits, offset amounts owed, and pursue any legal remedies available.
Section V – Shipping and Delivery
31. Buyer is responsible for all shipping, handling, and insurance charges, which will be added to the invoice or quoted separately.
32. Victorins Auctions may provide in-house packing and shipping as a courtesy but is not responsible for loss or damage in transit.
33. International Buyers are responsible for customs duties, taxes, and import fees. Some items may not be eligible for international shipping.
34. Insurance covers loss or damage only while in transit and not after delivery confirmation.
35. Victorins Auctions reserves the right to delay shipment until all funds have cleared.
36. As a courtesy, Victorins Auctions can provide delivery services, professionally packing, shipping, and insuring items to the Buyer’s provided address. Tracking will be emailed when shipped.
37. For wire transfer payments, Victorins Auctions can ship to any requested address. For credit or debit card payments via LiveAuctioneers, shipment must go to the payment address unless proof of an alternate address is provided.
38. Victorins Auctions is not responsible for shipping delays but will make best efforts to ship promptly.
39. Returns without written authorization will be refused, and unclaimed items after ninety (90) days may be deemed forfeited.
Section VI – Warranties, Disclaimers, and Condition Reports
40. All property is sold “as is” without warranties of any kind as to description, genuineness, attribution, provenance, authenticity, authorship, completeness, or condition.
41. Appraisals and estimates are provided for convenience only and may not reflect actual resale or replacement value.
42. All sales are final. Most rings are resizable unless signed by a designer or have stones around the full band. No guarantee of third-party appraisal is made unless specifically stated.
43. Watches may not include original boxes or papers and do not carry manufacturer warranties.
44. Condition reports and images are provided as a courtesy and should not replace physical inspection.
Section VII – Governing Law and Miscellaneous
45. This agreement is governed by the laws of the Commonwealth of Virginia. All participants consent to the exclusive jurisdiction of Virginia state courts, and federal courts where applicable.
46. If any clause of this agreement is found invalid, the remainder shall remain enforceable.
47. These Terms and Conditions constitute the entire agreement and supersede all prior understandings.
Section VIII – Payment Disputes and Chargeback Policy
48. By placing a bid, making a purchase, or completing payment on Victorins Auctions or any affiliated auction platform, including but not limited to LiveAuctioneers, Bidsquare, Invaluable, BidSpirit, HiBid, or by direct invoice, the Buyer acknowledges and agrees to be bound by this Payment Disputes and Chargeback Policy. All bids and purchases constitute legally binding contracts between the bidder and Victorins Auctions or its consignor. Once a lot is won or an invoice issued, the Buyer is obligated to complete payment in accordance with these Terms and Conditions of Sale, including Victorins Auctions’ Returns, Refunds, and Authenticity Policy.
49. The Buyer expressly waives any right to initiate or pursue a chargeback, payment reversal, or retrieval request with any credit card issuer, bank, or payment processor for any reason covered under these published policies. This waiver includes but is not limited to claims of buyer’s remorse or dissatisfaction with condition, value, or authenticity after sale, disputes arising from shipping delays, customs clearance, or third-party handling, allegations contradicted by condition reports, lot descriptions, photographs, or prior correspondence, and failure to fully review the lot listing or auction terms before bidding.
50. Any issue regarding description, condition, or delivery must be raised in writing within five (5) business days of delivery. Victorins Auctions reserves the right to review documentation and determine, at its sole discretion, whether an adjustment, repair, or store credit is appropriate. Attempting to bypass this process by filing a chargeback constitutes a breach of contract and may result in legal action, suspension of buyer privileges, and recovery of all associated costs.
51. The Buyer authorizes Victorins Auctions to retain all sales records, including bid logs, payment confirmations, shipping documents, photographs, and communications, as admissible evidence in any dispute, arbitration, or legal proceeding. These materials may be provided to financial institutions or dispute resolution bodies to establish fulfillment of contractual obligations.
52. Chargebacks determined to be fraudulent, unfounded, or contrary to the Buyer’s signed agreement or digital acceptance entitle Victorins Auctions to seek reimbursement for the full transaction amount, collection and legal fees, administrative time, and any resulting damages to reputation or platform standing. Victorins Auctions reserves the right to pursue collection, report the Buyer to relevant platforms and credit bureaus, and deny future participation in any sale or event.
Section IX – Authenticity Guarantee and Dispute Resolution
53. Victorins Auctions guarantees the authenticity of all items to the best of its knowledge and based on information available at the time of sale. Every item is carefully inspected and described in good faith.
54. In the rare event that a Buyer wishes to challenge an item’s authenticity, the claim must be supported exclusively by an official written determination issued directly by the original brand or manufacturer. Third-party appraisals, laboratory reports, or authentication services are not accepted under any circumstances. The document must be on official brand letterhead, signed or stamped by the issuing brand, and verifiable by Victorins Auctions.
55. Any item subject to an authenticity review must be returned in the exact same condition as originally delivered, including all packaging, accessories, boxes, certificates, and protective materials. Items that have been worn, altered, resized, polished, or modified in any way will not be eligible for review, credit, or return consideration.
56. If the authenticity claim is substantiated by the brand and confirmed by Victorins Auctions, the Buyer will be eligible for store credit only, equal to the purchase price paid, excluding shipping, insurance, and related fees. No cash or card refunds are issued under any circumstances, and store credit is non-transferable and may be applied toward future purchases.
57. Any authenticity inquiry must be submitted in writing within seven (7) calendar days of receipt of the item. Claims submitted after this period, or without verifiable brand documentation, will not be considered.
