Terms & Conditions

Section I – General Conditions of Sale

1. These Conditions of Sale constitute the agreement between Victorins LLC, doing business as Victorins Auctions (“Victorins,” “Auctioneer,” “we,” or “us”) and the consignor (“Consignor”) with the buyer (“Buyer”) for the property listed in any Victorins auction catalog or presented for sale.

2. The Conditions of Sale, glossary, and all other content of the catalog or online listing are subject to amendment by Victorins Auctions by posted notice, announcement during the sale, or other written notice.

3. All property is offered by Victorins Auctions as agent for the Consignor unless expressly stated otherwise in the catalog.

4. By participating in any sale, whether in person or through any online or third‑party platform, the Consignor, Bidder, and Buyer agree that these Conditions of Sale govern the transaction and shall prevail in the event of any conflict with platform terms, except where prohibited by law.

5. Victorins Auctions reserves the right to amend or supplement these terms at any time, including announcements made during an auction, which shall be binding.

6. All bidders are deemed to have read, understood, and agreed to these Terms and Conditions before bidding.

Section II – Registration and Bidding

7. Bidders must register prior to bidding by completing a registration form in person or online, providing proof of identification, and supplying bank or other financial references if requested.  Victorins Auctions may deny or revoke registration at its sole discretion and may require updated identification or financial information at any time.

8. By registering, the Bidder agrees to be liable for all bids placed under their account or bidder number, whether placed by the Bidder or by any person using the Bidder’s credentials. The Bidder is solely responsible for maintaining the security of their account information.

9. Bidders are responsible for independently verifying the age, size, condition, authenticity, description, and value of each lot before bidding. All descriptions, condition reports, and statements by Victorins Auctions are opinions only and are not warranties of any kind.

10. All bids are per lot as numbered in the catalog unless otherwise announced by the Auctioneer.

11. Victorins Auctions may reject any bid, refuse bidding privileges, or suspend or permanently ban any Bidder at its sole discretion, including across all third‑party platforms.

12. The Auctioneer may split or alter bidding increments, reject insufficient advances, resolve any bidding dispute, and determine the winning bidder. The Auctioneer’s decision shall be final and binding. In the event of a dispute, the Auctioneer may re‑offer the lot at their discretion.

13. In the case of absentee bids, Victorins Auctions will attempt to purchase the lot at the lowest price possible, subject to reserves and competing bids, but is not responsible for errors, failure to execute bids, or inability to contact bidders by phone or online.

14. Online and phone bidding are offered as a convenience, and Victorins Auctions is not responsible for any technical failures, connectivity issues, delays, platform outages, or errors in the execution or transmission of bids.

15. Victorins Auctions reserves the right to withdraw any lot at any time before or during the sale without liability to any Bidder or Consignor.

Section III – Sale and Title Transfer

16. Placing a bid constitutes a legally binding, irrevocable offer to purchase the lot, subject to these Conditions of Sale.  Once placed, bids may not be withdrawn or cancelled.

17. Upon the fall of the Auctioneer’s hammer, the highest acknowledged Bidder becomes the Buyer and assumes all risk of loss. Title to the lot shall pass to the Buyer only upon Victorins Auctions’ receipt of the full purchase price in cleared funds.

18. A buyer’s premium of twenty percent (20%) of the successful bid price will be added to all lots and is payable by the Buyer as part of the total purchase price.

19. Video, digital images, and online representations may be used during the sale for convenience only. Such images are for reference and may not accurately reflect color, size, or condition. Victorins Auctions is not liable for errors or variations in image quality or presentation.

20. Reserves may be executed by the Auctioneer, by Victorins Auctions, or by an authorized representative on behalf of the Consignor, including through automated or absentee bidding systems.

Section IV – Payment Terms

21. Payment is due immediately after the auction for the full purchase price, including the hammer price, buyer’s premium, applicable taxes, and any additional fees.

22. Accepted payment methods include U.S. dollars by cash, check, wire transfer, or credit card through the online auction platform. Victorins Auctions may refuse any form of payment, require identity verification, or require an alternative payment method at its discretion.

23. A surcharge may be imposed on all credit card transactions, not greater than the cost of acceptance.

24. If the Buyer has a card on file with LiveAuctioneers or any other bidding platform, Victorins Auctions is authorized to charge that card for the full invoice amount seventy‑two (72) hours after the invoice is issued unless alternative arrangements are made in writing. The Buyer is responsible for maintaining accurate and current payment information with all platforms.

25. Invoices must be paid either entirely through the applicable platform’s payment system or entirely by direct payment to Victorins Auctions. Mixed payment methods for a single invoice are not permitted.

26. For payments exceeding one thousand and five hundred dollars ($1,500) or for new bidders without sufficient payment history, Victorins Auctions requires payment via bank transfer, Zelle, or check. Victorins Auctions may impose this requirement at its discretion for any transaction.

27. Sales tax will be applied in accordance with applicable state and local laws. For out‑of‑state Buyers, tax may not be charged on direct payments to Victorins Auctions where legally permitted. Payments processed through third‑party platforms may be subject to tax collection by those platforms pursuant to their own policies and applicable law.

28. The Buyer agrees not to initiate any chargeback, payment reversal, or retrieval request except in cases of actual fraud or unauthorized use of the Buyer’s payment method. The Buyer must first submit any dispute, concern, or issue to Victorins Auctions through Victorins’ internal dispute resolution process before contacting their bank or card issuer.  Filing a chargeback in violation of these Conditions of Sale constitutes a breach of contract. Even if a chargeback is processed, the Buyer remains liable for the full purchase price, together with all platform penalties, administrative costs, collection costs, fees, and reasonable attorney’s fees incurred by Victorins Auctions in responding to or reversing the chargeback.

29. A late fee of one and one-half percent (1.5%) per month, or the maximum rate permitted by law, will be charged on any overdue balance until paid in full. Returned checks will incur additional fees.

30. If the Buyer fails to make full payment when due, Victorins Auctions may, without limitation: (a) cancel the sale; (b) resell the lot publicly or privately, with the Buyer liable for any deficiency and all associated costs; (c) retain any deposits or payments made; (d) offset any amounts owed against funds or property held for the Buyer; (e) refer the account to a collection agency or attorney; and (f) report the Buyer’s default to bidding platforms or other relevant parties. All remedies are cumulative and may be pursued concurrently.

If the Buyer fails to pay for, collect, accept delivery of, or provide shipping instructions for any lot within ten (10) days after the invoice date, Victorins Auctions may charge storage fees of $15 per day per lot, or the maximum amount permitted by law, beginning on the eleventh (11th) day. Victorins Auctions may also charge a $50 administrative fee for account handling, repackaging, rescheduling, or additional processing caused by Buyer delay or non‑performance.  Victorins Auctions may, in its sole discretion, waive or reduce any storage or administration fees on a case-by-case basis. 

Items not collected or shipped within ninety (90) days of the invoice date may be deemed abandoned under §39 and disposed of at Victorins Auctions’ discretion, without refund. The Buyer remains liable for all accrued fees, deficiencies, and costs of collection.

 

Section V – Shipping and Delivery

31. Buyer is responsible for all shipping, handling, and insurance charges, which will be added to the invoice or quoted separately.  All such charges must be paid in full before the lot is released or shipped.

32. Victorins Auctions may provide in-house packing and shipping as a courtesy.  Victorins Auctions is not liable for loss or damage in transit beyond the coverage provided by any insurance purchased by the Buyer.  All packing is performed using commercially reasonable methods, but no warranty is made regarding packing adequacy.

33. International Buyers are responsible for all customs duties, taxes, import fees, and compliance with destination‑country regulations. Victorins Auctions is not responsible for customs delays, holds, or seizures. Certain items may not be eligible for international shipment due to legal or carrier restrictions.

34. Insurance covers loss or damage only while in transit and not after delivery confirmation by the carrier.  Insurance may be purchased by the Buyer at their request or included in the shipping and handling charges quoted by Victorins Auctions when Victorins Auctions arranges shipment.  Victorins Auctions is not an insurer and is not responsible for any loss, theft, or damage beyond the limits, terms, and conditions of any insurance actually in place.  If the Buyer declines insurance, or if insurance is unavailable for the destination or item, shipment proceeds at the Buyer’s sole risk after dispatch.

35. Victorins Auctions reserves the right to delay shipment until all funds have cleared.

36. As a courtesy, Victorins Auctions can provide delivery services, professionally packing, shipping, and insuring items to the Buyer’s provided address. Tracking will be emailed when shipped.

37. For wire transfer payments, Victorins Auctions can ship to any requested address. For credit or debit card payments via LiveAuctioneers, shipment must go to the payment address unless proof of an alternate address is provided.

38. Victorins Auctions is not responsible for carrier delays, weather‑related delays, customs delays, or other circumstances beyond its control, but will make reasonable efforts to ship promptly once payment has cleared.

39. No returns will be accepted without prior written authorization issued by Victorins Auctions. Written authorization must be provided by email from an official Victorins Auctions email address and must include a Return Authorization Number (“RA Number”). Returns sent without an RA Number will be refused and returned to the Buyer at the Buyer’s expense.

Section VI – Warranties, Disclaimers, and Condition Reports

40. All property is sold “as is,” without any warranty, representation, or guarantee of any kind, whether express or implied, including as to description, genuineness, attribution, provenance, authenticity, authorship, completeness, condition, or fitness for a particular purpose. No statement by Victorins Auctions, whether oral, written, or contained in the catalog or online listing, shall be deemed a warranty or assumption of liability. Buyers are solely responsible for determining the condition and value of the property prior to bidding.

41. Any appraisals, estimates, or valuations provided by Victorins Auctions are for convenience only and do not constitute a warranty or guarantee of actual resale, replacement, or market value. Such estimates reflect the opinion of Victorins Auctions at the time of cataloging and may differ from current market conditions.

42. All sales are final. No refunds, returns, exchanges, or cancellations are permitted. Most rings may be resizable at the Buyer’s discretion; however, Victorins Auctions makes no representation or warranty regarding the feasibility, cost, or outcome of any resizing. Designer‑signed rings or rings with stones set around the full band may not be resizable. No guarantee of third‑party appraisal or certification is made unless expressly stated in the lot description.

43. Watches may not include original boxes or papers and do not carry manufacturer warranties. Victorins Auctions does not guarantee the accuracy, water resistance, service history, or future performance of any watch. Buyers are encouraged to have watches inspected or serviced by a qualified watchmaker after purchase.

44. Condition reports, photographs, and other statements regarding condition are provided as a courtesy and reflect Victorins Auctions’ good‑faith opinion at the time of cataloging. Such reports may not describe all faults, restorations, repairs, or imperfections. They are not warranties of any kind and do not replace the Buyer’s obligation to inspect the property prior to bidding.

Section VII – Governing Law and Miscellaneous

45. These Conditions of Sale and all transactions with Victorins Auctions are governed by the laws of the Commonwealth of Virginia, without regard to conflict‑of‑law principles. The Bidder and Buyer consent to the exclusive jurisdiction and venue of the state courts located in Virginia, and the federal courts located in the Eastern District of Virginia, for any dispute arising out of or relating to any auction or transaction. The Bidder and Buyer waive any objection to personal jurisdiction or venue in such courts.

46. If any clause of this agreement is found invalid, the remainder shall remain in full force and effect. Any invalid or unenforceable provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.

47. These Terms and Conditions constitute the entire agreement and supersede all prior  or contemporaneous understandings, representations, or agreements, whether oral or written, relating to the subject matter.  No oral statements or representations by Victorins Auctions or its staff shall modify these Conditions of Sale unless expressly confirmed in a written amendment issued by Victorins Auctions. 

Section VIII – Payment Disputes and Chargeback Policy

48. By placing a bid, making a purchase, or completing payment on Victorins Auctions or any affiliated auction platform, including but not limited to LiveAuctioneers, Bidsquare, Invaluable, BidSpirit, HiBid, or by direct invoice, the Buyer acknowledges and agrees to be bound by this Payment Disputes and Chargeback Policy. All bids and purchases constitute legally binding contracts between the bidder and Victorins Auctions or its consignor. Once a lot is won or an invoice issued, the Buyer is obligated to complete payment in accordance with these Conditions of Sale, including Victorins Auctions’ Returns, Refunds, and Authenticity Policy.  Any dispute must be raised directly by Victorins Auctions before the Buyer contacts their bank or payment provider.

49. The Buyer expressly agrees not to initiate any chargeback, payment reversal, or retrieval request except in cases of actual fraud or unauthorized use of the Buyer’s payment method. Chargebacks based on buyer’s remorse, dissatisfaction with condition or value, shipping delays, customs issues, or matters contradicted by the lot description, photographs, condition reports, or these Conditions of Sale are improper and constitute a breach of contract.  Chargebacks filed without first completing Victorins Auctions’ internal dispute process are deemed improper and in bad faith.

50. Any issue regarding description, condition, or delivery must be raised in writing within five (5) business days of delivery. Victorins Auctions reserves the right to review documentation and determine, at its sole discretion, whether an adjustment, repair, or store credit is appropriate. Attempting to bypass this process by filing an improper chargeback constitutes a breach of contract and may result in legal action, suspension of buyer privileges, and recovery of all associated costs.  Improper chargebacks may also result in platform penalties or account sanctions imposed by third-party marketplaces, for which the Buyer is responsible.

51. The Buyer authorizes Victorins Auctions to retain all sales records, including bid logs, payment confirmations, shipping documents, photographs, and communications, as admissible evidence in any dispute, chargeback proceeding, arbitration, or legal proceeding. Victorins Auctions may provide such records to payment processors, financial institutions, platforms, or dispute resolution bodies as necessary to demonstrate fulfillment of contractual obligations.  The Buyer expressly consents to Victorins Auctions’ submission of these records for the purpose of contesting or reversing any improper chargeback. 

52. If a chargeback is determined to be improper, unfounded, or in violation of these Conditions of Sale, the Buyer remains liable for the full purchase price, together with all costs incurred by Victorins Auctions in responding to the chargeback, including administrative time, platform penalties, collection costs, and reasonable attorney’s fees. Victorins may pursue collection, cancel bidding privileges, notify bidding platforms of the Buyer’s default, and take any other lawful action necessary to recover the outstanding balance.  Improper chargebacks constitute a material breach of contract and may result in permanent suspension from all Victorins Auctions sales and platforms.

Section IX – Authenticity Guarantee and Dispute Resolution

53. Victorins Auctions guarantees the authenticity of all items to the best of its knowledge and based on information available at the time of sale. All descriptions and statements regarding authenticity reflect Victorins Auctions’ good-faith opinion and do not constitute a warranty or guarantee.

54. In the rare event that a Buyer wishes to challenge an item’s authenticity, the claim must be supported exclusively by an official written determination issued directly by the original brand or manufacturer. Third-party appraisals, laboratory reports, or authentication services are not accepted as a basis for any remedy.  

However, Victorins Auctions may, in its sole discretion, consider documentation from certain third-party institutions that Victorins Auctions recognizes as authoritative (such as GIA, IGI, or a brand-authorized service center).  Victorins Auctions’ determination as to whether such documentation is accepted is final. 

All document must be on official letterhead, signed or stamped by the issuing entity, and verifiable by Victorins Auctions.

55. Any item subject to an authenticity review must be returned in the exact same condition as originally delivered, including all packaging, accessories, boxes, certificates, and protective materials. Items that have been worn, altered, resized, polished, or modified in any way will not be eligible for review, credit, or return consideration.

56. If the authenticity claim is substantiated by the brand and confirmed by Victorins Auctions, the Buyer will be eligible for store credit only, equal to the purchase price paid, excluding shipping, insurance, and related fees. No cash or card refunds are issued under any circumstances, and store credit is non-transferable and may be applied toward future purchases.

57. Any authenticity inquiry must be submitted in writing within seven (7) calendar days of receipt of the item. The Buyer must provide initial notice within this seven (7) day period; supporting documentation under paragraph 54 may follow within a reasonable time thereafter, not to exceed an additional fourteen (14) calendar days from the date of initial notice.  Claims submitted after this period, or without verifiable brand documentation (or other documentation accepted at Victorins Auctions’ sole discretion under paragraph 54), will not be considered.

Section X – Confidentiality, Non-Disclosure, and Non-Disparagement

58. The Buyer agrees to keep confidential any non‑public business information obtained through their dealings with Victorins Auctions, including internal processes, proprietary pricing methods, employee information, and non‑public communications. This confidentiality obligation does not apply to information that is publicly available, independently obtained, or related to the Buyer’s own experience with a transaction. Confidentiality expressly includes Victorins Auctions’ internal workflows, pricing strategies, authentication methods, and operational procedures.

59. All non-public information relating to Victorins Auctions, including but not limited to transaction terms, purchase prices, reserves, identities of bidders/buyers/consignors/sellers, internal communications, authentication methods, documentation shared, due diligence materials, and any private dealings, negotiations, or experiences involving Victorins Auctions (collectively, “Confidential Information”) shall be treated as strictly confidential and may not be disclosed publicly or to third parties except as required by law.  This includes any attempt to publicly reveal or weaponize Confidential Information as part of a coordinated or bad-faith effort to harm Victorins Auctions.

60. The Buyer may share their honest opinions and experiences regarding Victorins Auctions, including through reviews, provided such statements are truthful and not false, misleading, defamatory, or made with reckless disregard for the truth. The Buyer agrees not to publish or communicate any knowingly false statements of fact about Victorins Auctions, its employees, its services, or any item purchased.  This Section is intended to comply with the Consumer Review Fairness (CRFA) while prohibiting bad-faith or deceptive statements.

61. Participants shall not make or encourage any false, misleading, or bad-faith statements of fact regarding the authenticity, condition, description, or delivery of any item purchased, or regarding Victorins Auctions’ business practices, employees, or services.  Statements of opinion are not prohibited, but must not be presented as fact or used as a vehicle for coordinated smear campaigns or bad-faith attacks.

62. Disclosure is permitted only to the extent required by law, subpoena, court order, regulatory request, or legal counsel. Participants agree to provide Victorins Auctions prompt written notice of any compelled disclosure request (where legally permitted) so that Victorins Auctions may seek protective relief.  Nothing in this Section permits disclosure of Confidential Information for retaliatory, harmful, or bad-faith purposes.

63. If the Buyer publishes or communicates any knowingly false, misleading, or defamatory statements of fact, or otherwise violates this Section, Victorins Auctions may pursue all lawful remedies, including injunctive relief, removal or takedown requests, recovery of provable damages, consequential damages, and reasonable attorney’s fees. Nothing in this Section shall be construed to limit the Buyer’s right to share truthful opinions or factual experiences.

64. This Section survives indefinitely and applies universally across all Victorins Auctions auctions, sales, consignments, direct sales, private purchases, and all affiliated auction platforms and payment channels. Any breach of this Section constitutes a material breach of these Conditions of Sale and may result in permanent suspension, cancellation of bids/orders, refusal of future transactions, and legal action.

Section XI – Communications, Marketing, and Consent

65. By registering to bid, creating an account, submitting contact information, making a purchase, consigning property, selling property directly to Victorins Auctions, the bidder, buyer, consignor, seller, or other participant (“Participant”) expressly consents to receive communications from Victorins Auctions.  These may include: (a) transactional and account‑related communications such as registration confirmations, invoices, payment reminders, identity‑verification requests, and shipping updates; and (b) marketing and promotional communications such as auction announcements, catalog releases, event updates, special offers, previews, and personalized recommendations. Consent to receive marketing communications is not a condition of bidding, purchase, or sale where prohibited by law.

66. Communications may be delivered by mail, email, telephone calls, text message (SMS), WhatsApp, or other messaging platforms, and may be sent using automated systems where permitted by law. Participants represent that the phone number and email address provided to Victorins Auctions are valid and belong to them or are authorized for use.

67. Participants may opt out of marketing communications at any time by using the “unsubscribe” link in email communications or by replying STOP to SMS messages (where applicable). Notwithstanding any marketing opt-out request, Participants acknowledge that Victorins Auctions may still send transactional, account-related, and legally required communications (including invoices, payment reminders, identity verification requests, shipping updates, dispute correspondence, and compliance notices).
