GENERAL

These terms and conditions take effect from your first use of Ziebarths.com, or by bidding on any Ziebarths Auction via the use of an outside third party bidding platform. 

TERMS

1. CONTRACT: Your bid is a contract. If you are the successful and winning bidder, you have entered into a legally binding contract to purchase the property bid on from Ziebarth’s Auctions. You may contact Ziebarth’s Auctions to resolve any questions before bidding by emailing info@ziebarths.com

2. BIDDING: Bidders may view auction catalogs, and bid on items offered by Ziebarth’s Auctions via several formats listed below. All purchases made from Ziebarth’s Auctions are entitled to a buyers premium which is to be paid by the buyer, and added to the purchase price of each item as a percentage. Ziebarth’s Auctions buyers premiums are outlined below:

  • Phone & Absentee Bidding (18% buyers premium)

ONLINE MARKETPLACES:

4: RIGHTS: Ziebarth's Auctions, at its sole discretion, reserves the right to reject any opening bid, which is unacceptable or too low. The Auctioneer also reserves the right to withdraw any property before the sale, or cancel the sale of any item within 72 hours after a sale.

5. INTERNET BIDDING: Live internet bidding is available as a courtesy during the auction. Ziebarth's Auctions shall not be held responsible for live internet bids that are not sent, received, or executed by the administrator. 

 

6. RISKS AND RESPONSIBILITIES: Once an item is announced "Sold", title to the property will immediately pass to the highest bidder acknowledged. Once title to the property has passed to the highest bidder, such bidder (a) assumes all risks and responsibilities (b) will pay the full purchase price plus buyer's premium (c) will arrange for packing and shipping. 

 

7. PAYMENT TERMS: All invoices from Ziebarth’s Auctions must be paid within five (5) business days after completion of the auction. Ziebarth's Auctions will email an invoice to all winning bidders within 72 hours of the end of an auction. Failure to make payment arrangements within the 5 days will result in a Non Paying Bidder being placed on your account. Ziebarth's Antiques reserves the right to hold items paid by check until the check clears. There is a handling charge of $25.00 for dishonored checks. 

 

8. All property and items are sold as is and all sales are final. Ziebarth’s Auctions will describe the items for sale to the best of our ability, however, there are no guarantees, expressed or implied, that these descriptions are explicit. The bidder is solely responsible for determining the age, size, condition and value of the property before bidding. Neither the Auctioneer nor the Consignor will be held responsible for any descriptions of the rarity, quality, condition, size, importance, or provenance of the property, and no statement, whether oral or written, by the Auctioneer or by any representative of Ziebarth's Auctions shall be deemed a warranty or representation regarding the property offered for sale. 

9. GOVERNING STATE: All terms and conditions of sale are governed in accordance with the laws of the State of Wisconsin. 

10. ACCEPTANCE: Bidding on any item indicates your acceptance of these terms and conditions of sale. 

11. STORAGE: Items purchased and not picked up or without shipping arrangements, or any outstanding in-house shipping invoice after 30 days after the sale will be subject to a storage fee of $10 per day to be added to the invoice of the purchaser for each outstanding item purchased. 

12. FORFEITURE: Items purchased and left with no shipping arrangements, or outstanding shipping invoices, for more than 60 days after the conclusion of an auction are subject to forfeit by the purchaser, and therefore become the sole property of Ziebarth’s Auctions.

 

13. RESERVE: Any item may be held to a minimum price ('reserve price') disclosed or undisclosed at the Auctioneers ('sellers') discretion. If the reserve price is not reached, the Lot will be passed.

14. ORDER OF BIDS TAKEN: Given Ziebarth’s Auctions is taking bids from several platforms, it is possible that exact absentee bids for items could be left on varying platforms. The order of bid priority for bids received will be the following: 1. Phone/Absentee Bids, 2. ZiebarthsLIVE, 3. BidSquare, 4. BidSpirit, 5. LiveAuctioneers.
