The highest qualified bidder recognized by the auctioneer shall be the Buyer. All successful bids are subject to a Buyer’s Premium in addition to the hammer price, as published for each auction. Abell reserves the right to reject any bid, withdraw any lot, reoffer any lot in the event of dispute, and refuse participation to any bidder in its sole discretion. In the event of a dispute, the auctioneer’s decision shall be final and binding. If a bid is placed on behalf of an entity, the individual placing the bid personally guarantees payment. Abell is not responsible for bidding errors, missed bids, technical failures, or the failure to execute absentee, telephone, or internet bids. All sales are final. Property must be removed within seven days of the auction date. After seven days, storage fees of the greater of $25 per lot per day or 10 percent of the purchase price per item, plus a $75 handling fee, shall apply. Property not removed within twenty-one days shall be deemed abandoned, and Abell may resell or dispose of such property without liability. Buyer remains responsible for any deficiency, storage fees, legal fees, collection costs, and all related expenses. Buyers are responsible for all applicable sales taxes unless proper documentation is on file with Abell before the auction. If Buyer fails to comply with these Terms and Conditions, Abell may cancel the sale, retain payments as liquidated damages, resell the property publicly or privately, and hold Buyer liable for any deficiency and all related costs, including attorneys’ fees and expenses. Any dispute arising under these Terms shall be resolved exclusively by binding arbitration administered by JAMS under California law in Los Angeles, California, and the prevailing party shall be entitled to recover reasonable attorneys’ fees and costs.
