10.1. Shipping Arrangements

Gallery Arts & Auctions LLC is pleased to assist buyers with domestic and international shipping. Shipping may be arranged through the gallery or, upon request, through the buyer’s preferred professional carrier, subject to prior coordination with the gallery.

10.2. Shipping Costs

Shipping costs are the responsibility of the buyer and are calculated individually according to the item and destination. Buyers may request a shipping estimate before or after the auction.

10.3. Professional Packing

All purchased lots are carefully and professionally packed according to their size and characteristics. Particular care is given to paintings, ceramics, sculptures, textiles, handcrafted works, and other delicate objects for safe transportation.

10.4. Shipping Providers

Shipments may be coordinated through DHL Express, UPS, or other appropriate professional logistics providers according to the item and destination.

10.5. Payment & Dispatch

Purchased lots will be prepared for shipment after full payment has been received and confirmed. Preparation and dispatch times may vary depending on the item, destination, and selected shipping service.

10.6. Tracking & International Shipments

Tracking information will be provided whenever available. For international shipments, the gallery will provide reasonable assistance with the necessary shipping documentation. Any applicable customs duties, taxes, import charges, or destination-country fees are the responsibility of the buyer.

1) Acceptance & Scope

1.1. Participation in our auctions or sales (live, timed online, or “Buy Now”) constitutes full acceptance of these Terms & Conditions, in addition to the rules and policies of the hosting platform (e.g., Bidsquare).

1.2. By registering and bidding, each bidder acknowledges that they have read, understood, and agreed to these Terms and to any additional notices posted for a specific sale.

Collection Quality Statement

Each auction is carefully curated to present a diverse selection of artworks, ceramics, handcrafted works, and decorative objects chosen for their artistic, historical, cultural, or decorative significance.

The gallery strives to offer collectors opportunities to acquire works representing a wide range of artistic movements, cultural traditions, styles, techniques, and collecting interests.

2) Artwork Descriptions & Terminology

2.1. All property is sold “as is,” in the condition and with the characteristics existing at the time of sale.

2.2. Descriptions reflect the gallery’s good-faith market opinion and are not intended as formal expert authentication reports.

2.3. Original Contemporary Peruvian Ceramics & Handcrafted Works
The contemporary Peruvian ceramics and handcrafted works specifically identified in this auction as original works by named artists or artisans are offered as original creations by those artists or artisans, based on direct acquisition, artist information, available documentation, and the gallery’s records.

Where applicable, these works may be accompanied by, or may be eligible to receive, artist-issued documentation or a Certificate of Authenticity. Any such documentation will be expressly indicated in the individual lot description or provided when available.

This provision is separate from works cataloged using attribution terminology such as “Attributed to,” “Circle / School / Studio of,” “In the manner or style of,” or “After,” which remain subject to the attribution provisions below and are not guaranteed as autograph works by the named artist.

2.4. To communicate a work’s relationship to an artist or movement, the gallery may use internationally recognized attribution terminology, including:

  • [Artist’s Name]: In our opinion, the work is by the named artist.
  • Attributed to [Name]: Probably by the artist, but not conclusive.
  • Circle / School / Studio of [Name]: From the artist’s milieu or influence.
  • In the manner or style of [Name]: A later work emulating the artist’s aesthetic.
  • After [Name]: Based on a known work by the artist.

These designations represent market opinions consistent with general auction practice and are not guarantees of authorship, authenticity, or origin. Attribution terminology follows generally accepted international auction-market practice.

2.5. Ceramics, Handcrafted Works & Decorative Objects

Descriptions of ceramics, textiles, sculptures, handcrafted objects, decorative works, and similar property are prepared in good faith using available information regarding the artist or artisan, materials, techniques, regional traditions, physical characteristics, available documentation, and information supplied to the gallery.

Unless expressly stated otherwise in the individual lot description, references to an artist, artisan, workshop, cultural tradition, region, technique, or period reflect the information reasonably available to the gallery at the time of cataloging.

Handcrafted objects may display natural variations, irregularities, tool marks, firing variations, surface differences, or other characteristics inherent to handmade production. Such characteristics do not necessarily constitute damage or defects.

Collector Information

Many artworks and objects offered through Gallery Arts & Auctions LLC originate from private collections, estates, galleries, dealers, consignors, artists, artisans, workshops, and secondary-market sources. Information provided in lot descriptions reflects available research, stylistic analysis, consignor records, market references, documentation, and historical information available at the time of cataloging.

Information is compiled from available sources believed to be reliable at the time of cataloging; however, except where expressly stated otherwise, such information should not be considered a guarantee of authorship, authenticity, provenance, origin, date, or attribution.

3) Photos, Measurements & Frames

3.1. Photographs form an integral part of each description; slight variations in color or tone may occur due to lighting, photography, or screen settings.

3.2. Measurements are approximate.

3.3. Frames are included only if visible or mentioned; decorative frames are not considered part of the artwork’s value.

3.4. For handmade ceramics and decorative objects, minor variations in surface, texture, coloration, glaze, firing, dimensions, or handcrafted details may be inherent characteristics of the object.

4) Pre-sale Inspection & Inquiries

4.1. Buyers should carefully review all images and descriptions before bidding and submit inquiries at least 48 hours prior to the auction.

4.2. The absence of a condition report does not imply that an item is free from imperfections, restorations, wear, age-related characteristics, or other condition issues.

4.3. Buyers interested in large, fragile, ceramic, sculptural, or oversized lots are encouraged to request additional information regarding dimensions, weight, condition, or approximate shipping costs before bidding.

5) Registration, Bidding & Reserves

5.1. The gallery and/or platform reserve the right to approve or reject bidder registration or bids at their discretion.

5.2. Some lots may carry a confidential reserve price.

5.3. All bids are binding and constitute a legal purchase obligation.

5.4. In case of dispute, technical error, or platform issue, the gallery or platform may determine the winning bidder or reoffer the lot.

5.5. High-value transactions may require identity or payment verification in accordance with gallery or platform policies.

5.6. The gallery reserves the right to withdraw any lot prior to or during the auction when reasonably necessary due to cataloging issues, condition concerns, regulatory matters, consignor instructions, or other circumstances affecting the sale.

6) Hammer Price & Buyer’s Premium

6.1. A Buyer’s Premium of 10% will be added to the hammer price by the Gallery. An additional 5% platform premium may be charged by Bidsquare, resulting in a total Buyer’s Premium of up to 20%.

6.2. Additional payment-processing fees, if applicable, may apply depending on the selected payment method.

7) Taxes, Customs & Compliance

7.1. Applicable taxes will be charged in accordance with applicable laws.

7.2. Buyers are responsible for applicable import duties, VAT, customs fees, taxes, and destination-country requirements.

7.3. Customs delays or denials do not automatically justify cancellation or non-payment.

7.4. Cultural Property & Export Requirements. Certain artworks, ceramics, traditional crafts, decorative objects, or cultural property may be subject to review, documentation, authorization, export procedures, customs requirements, or other regulations imposed by the competent authorities in the jurisdiction from which the property is shipped.

Where applicable, Gallery Arts & Auctions LLC will coordinate or reasonably assist with the documentation and logistical procedures required prior to international dispatch. Buyers acknowledge that governmental, customs, cultural-property, or other regulatory procedures may extend normal handling and delivery times.

The gallery cannot guarantee processing times controlled by governmental authorities, customs agencies, or other third parties.

8) Payments

8.1. Payment must be completed within four (4) business days of the auction closing.

8.2. Accepted payment methods are strictly limited to the following:

• Bank transfer to one of our US business bank accounts (primary method)
• Payoneer transfer (from verified accounts)
• Payment via link.

8.3. The gallery operates exclusively with direct payment methods. We do NOT process credit or debit cards directly through the Bidsquare platform, and we do NOT collect payments through the Bidsquare platform.

8.4. PayPal and any other payment method not expressly approved by the gallery are NOT accepted.

8.5. By placing a bid, all bidders expressly acknowledge and agree that:

– Payments will be made ONLY through the methods listed above.
– The gallery does NOT charge registered cards through the auction platform.
– The buyer is fully responsible for completing payment using the approved methods.

8.6. Buyers must ensure they can make payment via bank transfer, Payoneer, or approved payment link before bidding.

8.7. Failure to use the accepted payment methods or to complete payment within the required period will be considered a breach of the sale conditions and may result in cancellation of the sale, recovery of applicable damages, account restrictions, or other remedies available to the gallery.

IMPORTANT PAYMENT NOTICE

Gallery Arts & Auctions LLC operates as a direct-payment auction house. Payment instructions will be provided directly by the gallery following the close of the auction.

By placing a bid, buyers acknowledge that payment must be completed using one of the approved payment methods listed in these Terms & Conditions.

Buyers are encouraged to review available payment methods prior to bidding and ensure they are able to complete payment within the required timeframe.

9) Passage of Title & Risk

9.1. Ownership transfers only after full payment has been received and confirmed.

9.2. Risk transfers to the buyer once the item has been properly packed and handed to the shipping carrier, subject to any applicable carrier insurance or mandatory law.

10) Shipping

10.1. Shipping Arrangements

Gallery Arts & Auctions LLC is pleased to assist buyers with domestic and international shipping. Shipping may be arranged through the gallery or, upon request, through the buyer’s preferred professional carrier, subject to prior coordination with the gallery.

10.2. Shipping Costs

Shipping costs are the responsibility of the buyer and are calculated individually according to the item and destination. Buyers may request a shipping estimate before or after the auction.

10.3. Professional Packing

All purchased lots are carefully and professionally packed according to their size and characteristics. Particular care is given to paintings, ceramics, sculptures, textiles, handcrafted works, and other delicate objects for safe transportation.

10.4. Shipping Providers

Shipments may be coordinated through DHL Express, UPS, or other appropriate professional logistics providers according to the item and destination.

10.5. Payment & Dispatch

Purchased lots will be prepared for shipment after full payment has been received and confirmed. Preparation and dispatch times may vary depending on the item, destination, and selected shipping service.

10.6. Tracking & International Shipments

Tracking information will be provided whenever available. For international shipments, the gallery will provide reasonable assistance with the necessary shipping documentation. Any applicable customs duties, taxes, import charges, or destination-country fees are the responsibility of the buyer.

10.7. Buyer Assistance

Buyers with questions regarding shipping or delivery options are encouraged to contact Gallery Arts & Auctions LLC. We are happy to assist before or after the auction and help make the shipping process as straightforward and convenient as possible.

11) Returns, Cancellations & Claims

11.1. All sales are considered final unless otherwise required by applicable law or platform policy.

11.2. Returns are not accepted solely because of color variance, frame condition, minor handmade variations, subjective opinions regarding value, or subjective opinions regarding attribution or authenticity, subject always to applicable law and platform policy.

11.3. Shipping damage claims must be reported within 48 hours of delivery and accompanied by clear photographs of the item, packaging, shipping label, and visible damage. Buyers must retain all original packing materials while a carrier claim is being evaluated.

11.4. The gallery will reasonably assist the buyer with applicable carrier or insurance claims relating to documented shipping damage.

12) Buyer Default

12.1. If a buyer fails to pay, the gallery may cancel the sale, resell the item, recover applicable damages, report the default to the hosting platform where permitted, restrict future bidding privileges, or pursue other remedies available under applicable law.

12.2. Defaulting buyers may be barred from future participation.

13) Limitation of Liability

13.1. To the maximum extent permitted by applicable law, the gallery’s total liability relating to a lot shall not exceed the amount actually paid for that lot.

13.2. The gallery is not responsible for indirect or consequential damages, lost profits, customs delays, governmental processing delays, carrier delays, or other third-party delays beyond the gallery’s reasonable control.

14) Privacy & Data Protection

Buyer data is used for transactional, compliance, payment, customer-service, and logistical purposes and may be shared where reasonably necessary with payment processors, carriers, the hosting platform, customs or governmental authorities, and other service providers involved in completing the transaction.

15) Intellectual Property & Images

Purchase of an item does not transfer copyright, trademark, reproduction, publication, or other intellectual-property rights unless expressly stated otherwise.

The gallery may use photographs and other images of property for cataloging, archival, promotional, educational, and marketing purposes.

16) Notices

Communications sent to the buyer’s registered email address or posted through the applicable auction platform or auction listing page are considered valid notices.

17) Governing Law & Arbitration

These Terms are governed by the laws of the State of New Mexico, USA, without regard to conflict-of-law principles.

To the extent permitted by applicable law, disputes arising from or relating to a transaction with Gallery Arts & Auctions LLC shall be resolved by binding arbitration seated in Albuquerque, New Mexico, unless the parties agree otherwise in writing or applicable mandatory law requires another procedure.

18) Severability & Amendments

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in effect to the fullest extent permitted by law.

The gallery may update these Terms from time to time and may publish additional conditions applicable to a particular auction or lot.

19) Collector Confidence & Market Practice

Gallery Arts & Auctions LLC conducts its business in accordance with generally accepted international auction-market practices. The gallery endeavors to present accurate descriptions, clear photography, responsive communication, professional packing, and professional transaction management.

Buyers acknowledge that works offered through the gallery may vary in age, origin, medium, attribution, provenance, condition, technique, cultural tradition, and method of manufacture, and that collecting inherently involves personal judgment, research, and individual collecting preferences.

The gallery encourages all bidders to perform their own due diligence prior to bidding.
